HomeMy WebLinkAboutCity Council Resolution 2008-072CITY OF PLYMOUTH RESOLUTION NO. 2008-072 ORDERING IMPROVEMENT COUNTY ROAD 101 RECONSTRUCTION 13TH AVENUE TO 30TH AVENUE CITY PROJECT NO. 5102 WHEREAS, the City Council adopted a resolution on the 8"' day of January, 2008, fixed a date for a public hearing with respect to the improvements to County Road 101, 131"' Ave to 30"' Ave; and WHEREAS, the proposed improvement includes the reconstruction of County Road 101 by the installation of concrete medians and widening for turn lanes at the intersections along with revisions to the existing storm drainage system and to the signal system at 14"' Avenue and County Road 6. Portions of the existing water main and related appurtenances will also be replaced; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held thereon the 12"' day of February, 2008, at which time all persons desiring to be heard were given an opportunity to be heard thereon, and WHEREAS, the public hearing was held, testimony taken and the public hearing was closed, and WHEREAS, further action on the proposed improvements was deferred to February 26, 2008, and WHEREAS, ordering this improvement requires a 4/5 vote of the council (six votes) since the project has not been petitioned for by the benefiting property owners; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the Preliminary Engineering Report. 2. Such improvement is hereby ordered as proposed in the Council resolution adopted February 26, 2008 Adopted by the City Council on February 26, 2008.
