HomeMy WebLinkAboutCity Council Resolution 2008-058CITY OF PLYMOUTH RESOLUTION 2008-058 APPROVING AN INTERIM USE PERMIT FOR THE CITY OF PLYMOUTH TO ALLOW A PLYMOUTH METROLINK PARK-AND-RIDE LOCATED AT THE SOUTHWEST CORNER OF NATHAN LANE AND 45TH AVENUE (2008001) WHEREAS, The City of Plymouth has requested approval of an interim use permit for reduced parking located at the southwest corner of Nathan Lane and 45th Avenue; and WHEREAS; the subject property is legally described as follows: Lot 1, Block 1, Holiday West Addition, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the City of Plymouth for an interim use permit, subject to the following findings and conditions: 1. An interim use permit for reduced parking is approved, in accordance with the January 7, 2008 City of Plymouth application, except as amended by this resolution. 2. The interim use permit allows a parking reduction of 74 parking spaces for Cub Foods, the strip retail building, and the Plymouth Metrolink park-and-ride, based on the finding that the applicable interim use standards have been met. 3. The interim use permit for reduced parking shall terminate if any of the following events occur: a. The use of any of the buildings changes to a use that increases the need for parking spaces. b. City staff documents a parking problem associated with inadequate parking. Resolution 2008-058 Page 2 (2008001) c. The floor area of any of the buildings is increased in a manner that adds to the number of parking spaces required. 4. All parking shall be off-street in designated areas that comply with the Zoning Ordinance. 5. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 6. This permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. ADOPTED by the City Council on February 12, 2008.
