HomeMy WebLinkAboutCity Council Resolution 2008-046CITY OF PLYMOUTH RESOLUTION 2008-046 APPROVING A SITE PLAN, CONDITIONAL USE PERMIT, INTERIM USE PERMIT, AND VARIANCE FOR RYAN COMPANIES US, INC. TO ALLOW CONSTRUCTION OF A PHARMACY WITHIN THE TARYN HILLS COMMERCIAL SITE FOR PROPERTY LOCATED IN THE NORTHEAST QUADRANT OF COUNTY ROAD 47 AND VICKSBURG LANE (2007092) WHEREAS, Ryan Companies US, Inc. has requested approval of a site plan, conditional use permit, interim use permit, and variance for a pharmacy within the Taryn Hills commercial site located in the northeast quadrant of County Road 47 and Vicksburg Lane, on property currently described as Outlot A, Taryn Hills Second Addition, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ryan Companies US, Inc. for a site plan, conditional use permit, interim use permit, and variance for a pharmacy within the Taryn Hills commercial site located in the northeast quadrant of County Road 47 and Vicksburg Lane, subject to the following conditions: I. The site plan for a 14,490 square foot pharmacy and related conditional use permit, interim use permit, and variance are hereby approved, in accordance with the plans received by the City on December 7, 2007, except as may be amended by this resolution. 2. Approval of the site plan is contingent upon City Council approval of final platting for the pharmacy site. 3. The conditional use permit requested to allow an accessory drive -up window is approved, based on the finding that all applicable conditional use standards have been met. The conditional use permit allows 24-hour operation of the accessory drive -up window for the pharmacy use. 4. The interim use permit requested to allow reduced parking is approved, based on the finding that all applicable interim use standards have been met. The landowner shall constrict five additional parking spaces if the City determines that there is a parking shortage on the site in the fiiture. Resolution 2008-046 (2007092) Page 2 5. The variance requested to allow reduced setback for the accessory drive -up window is approved, based on the finding that all applicable variance standards have been met. 6. Prior to recording the final plat, the following items shall be completed: a. A separate easement for the sidewalk along 61st Avenue and Shenandoah Lane shall be provided. Additionally, private cross -easements are required for the sanitary sewer, watermain, and storm sewer between Lot 1, Block 1 and Outlot A. b. A private cross -access easement shall be placed over the internal drive system within the development. The owners of the commercial development shall be responsible for maintenance of the internal drive system. The covenants and restrictions for the commercial development shall address this matter. c. The owners of the commercial development shall own and maintain Outlot B of Taryn Hills 2" a Addition in perpetuity. The covenants and restrictions for the commercial development shall address this matter, and shall be provided to the City for review and approval. d. A street light is required at the entrance on 61st Avenue. The annual operation cost for Wright Hennepin Electric is $154.45. Two years of energy operating cost is required by the City or $308.90. This amount shall be paid prior to the final plat being released for recording. 7. Prior to issuance of building permits, the following items shall be completed: a. The final plat shall be recorded with Hennepin County. b. The applicant shall submit the required Financial Guarantee and shall execute a Site Improvement Performance Agreement as required by the City. c. The applicant shall pay the park dedication fee in lieu of land dedication, in accordance with the Dedication Ordinance in effect at the time of building permit issuance. 8. Prior to issuance of building permits, the following revisions shall be made to the plans: a. Demonstrate that the lowest building opening where storm water may enter (door or window) is a minimum of 18 inches higher than the emergency overland overflow route. Show elevations on the grading plan. b. The contract documents shall include the City of Plymouth's standard details and specifications per the Engineering Guidelines. c. A concrete commercial driveway apron per City detail STRT-14 is required on 61st Avenue and on Shenandoah Lane. Existing curb openings must be replaced. d. On page C2 indicate where the "No Parking Fire Lane" signs will be placed. Also, relocate symbol "A" to its proper location south of the entrance drive and west of Shenandoah Lane. Resolution 2008-046 (2007092) Page 3 e. All storm sewer pipes shall be reinforced concrete pipe (RCP). Note this on page C6. f. Show one additional pipe length beyond each of the two proposed gate valves located west of Lot 1 in Outlot A. Also, add an 8 inch gate valve in the water main run located northwest of the drugstore and east of the northerly water service. g. Consider wet tapping the water main for fi ture water services in Outlot A, and eliminate the proposed services. h. Verify that the proposed 6 -inch water services for the pharmacy and all future uses in Outlot A are adequately sized. i. On sanitary manhole 1 no inside drop over two feet is allowed as shown on City detail SS -4 and SS -5. j. Storm sewer manholes 15 and 16 may need to be increased in diameter size from 54 inches to 60 inches. k. On the detail page include City details STRT-1 and SS -4. 1. One additional best management practice (BMP) is required for volume control (infiltration). The preferred location for the BMP is on Lot 1. If this can not be achieved a BMP on Outlet A sized appropriately for Lot 1 is required. This will be a requirement when Outlot A is developed. m. A street light is required at the entrance on 61" Avenue. 9. The developer shall obtain the necessary permits and approvals as follows: Elm Creek Watershed Management Commission, Minnesota Department of Health for watermain extension, Minnesota Pollution Control Agency for sanitary sewer extension, and NPDES. 10. The awnings, as shown on the elevation plans, shall be canvas or other approved fabric material. 11. The building elevations for the pharmacy on Lot 1 are approved in accordance with the drawings received by the City on December 7, 2007. The building elevations for the remaining commercial buildings (yet to be constricted) within this development shall be approved by the City, and shall incorporate some of the same or similar buildings materials and design elements—in order to create a unified and compatible appearance for the development. 12. Rooftop equipment shall be screened in compliance with the Zoning Ordinance. 13. Trash and recycling storage shall be in compliance with the Zoning Ordinance. 14. Signage shall comply with the signage regulations and shall receive prior approval of the appropriate sign permit. Resolution 2008-046 (2007092) Page 4 15. Standard Conditions: a. The applicant shall submit a reproducible 8 '/z x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any financial guarantees. b. The applicant shall submit reproducible mylar prints of sanitary sewer, water service, and storm sewer As-Builts for the site prior to the release or reduction of any financial guarantees. c. Fire hydrants, fire lane signage, post indicator valves, and fire department connections shall be placed in locations as approved by the Fire Inspector. d. Turning radius evaluations must indicate that fire apparatus do not extend into parking spaces or come in contact with curbing or other objects. e. Fire lane signs are required in approved locations to be identified by the Fire Inspector. f. The site plan, conditional use permit, interim use permit, and variance shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09, 21015.07, 21020.04, and 2 103 0. 06 respectively, of the Zoning Ordinance.
