HomeMy WebLinkAboutCity Council Resolution 2008-044CITY OF PLYMOUTH RESOLUTION 2008-044 APPROVING A FINAL PLAT FOR "TARYN HILLS COMMERCIAL ADDITION" FOR ONE COMMERCIAL LOT FOR A PHARMACY AND AN OUTLOT FOR FUTURE COMMERCIAL DEVELOPMENT, FOR PROPERTY LOCATED IN THE NORTHEAST QUADRANT OF COUNTY ROAD 47 AND VICKSBURG LANE (2007092) WHEREAS, Ryan Companies US, Inc. has requested approval of a final plat for property located in the northeast quadrant of County Road 47 and Vicksburg Lane; and WHEREAS, the property is currently legally described as Outlot A, Taryn Hills Second Addition, Hennepin County, Minnesota. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ryan Companies US, Inc. for a final plat for one commercial lot and an outlot for fiiture commercial development, for property located in the northeast quadrant of County Road 47 and Vicksburg Lane, subject to the following conditions: 1. The final plat is approved in accordance with the final plat drawings received by the City on December 13, 2007, except as may be amended by this Resolution. 2. Prior to recording the final plat, the following items shall be completed: a. A separate easement for the sidewalk along 61" Avenue and Shenandoah Lane shall be provided. Additionally, private cross -easements are required for the sanitary sewer, watermain, and storm sewer between Lot 1, Block I and Outlot A. b. A private cross -access easement shall be placed over the internal drive system within the development. The owners of the commercial development shall be responsible for maintenance of the internal drive system. The covenants and restrictions for the commercial development shall address this matter. c. The owners of the commercial development shall own and maintain Outlot B of Taryn Hills 2"a Addition in perpetuity. The covenants and restrictions for the commercial Resolution 2008-044 (2007092-F) Page 2 development shall address this matter, and shall be provided to the City for review and approval. d. A street light is required at the entrance on 61" Avenue. The annual operation cost for Wright Hennepin Electric is $154.45. Two years of energy operating cost is required by the City or $308.90. This amount shall be paid prior to the final plat being released for recording. 3. Prior to issuance of building permits for Lot 1, the following items shall be completed: a. The final plat shall be recorded with Hennepin County. b. The applicant shall submit the required Financial Guarantee and shall execute a Site Improvement Performance Agreement as required by the City. c. The applicant shall pay the park dedication fee in lieu of land dedication, in accordance with the Dedication Ordinance in effect at the time of building permit issuance. 4. The developer shall obtain the necessary permits and approvals as follows: Elm Creek Watershed Management Commission, Minnesota Department of Health for watermain extension, Minnesota Pollution Control Agency for sanitary sewer extension, and NPDES. 5. The awnings, as shown on the elevation plans for the pharmacy on Lot 1, shall be canvas or other approved fabric material. 6. The building elevations for the pharmacy on Lot 1 are approved in accordance with the drawings received by the City on December 7, 2007. The building elevations for the remaining commercial buildings (yet to be constricted) within this development shall be approved by the City, and shall incorporate some of the same or similar buildings materials and design elements—in order to create a unified and compatible appearance for the development. 7. Rooftop equipment shall be screened in compliance with the Zoning Ordinance. 8. Trash and recycling storage shall be in compliance with the Zoning Ordinance. 9. Signage shall comply with the signage regulations and shall receive prior approval of the appropriate sign permit. 10. Standard Conditions: a. The applicant shall submit a reproducible 8 '/z x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any financial guarantees. b. The applicant shall submit reproducible mylar prints of sanitary sewer, water service, and storm sewer As-Builts for the site prior to the release or reduction of any financial guarantees. Resolution 2008-044 (2007092-F) Page 3 c. Fire hydrants, fire lane signage, post indicator valves, and fire department connections shall be placed in locations as approved by the Fire Inspector. d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. e. This approval shall expire one year after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of the City Code. f. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
