HomeMy WebLinkAboutCity Council Resolution 2008-042CITY OF PLYMOUTH RESOLUTION NO. 2008-042 ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS 2008 MILL AND OVERLAY PROJECT CITY PROJECT NO. 8109 WHEREAS, the City Council adopted a resolution on the December 11, 2007, which fixed a date for a council hearing on the proposed improvement of the 2008 Mill and Overlay Project on Niagara Lane from Highway 55 to County Road 6, excluding the intersections of State Highway 55 and County Road 6, and WHEREAS, the mill and overlay removes and replaces the wearing course of bituminous on the street, replaces settled, cracked or heaved concrete curb and gutter, repairs storm and sanitary sewer strictures, replaces loop detectors and all necessary appurtenances; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held thereon the 22nd day of January 2008, at which all persons desiring to be heard were given an opportunity to be heard thereon, and WHEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes) since the project has not been petitioned for by the benefiting owners. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plymouth City Council of the City of Plymouth, Minnesota: I. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 2. Such improvement is hereby ordered as proposed in the Council resolution adopted January 22, 2008. 3. The Engineering Department shall prepare plans and specifications for the making of such improvement. 4. The City Council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of the tax exempt bond. Adopted by the City Council on January 22, 2008.
