HomeMy WebLinkAboutCity Council Resolution 2008-041CITY OF PLYMOUTH RESOLUTION NO. 2008-041 ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS 2008 STREET RECONSTRUCTION PROJECT CITY PROJECT NO. 8101 WHEREAS, the City Council adopted a resolution on the 11th day of December, 2007, which fixed a date for a council hearing on the proposed improvement of West Medicine Lake Area, located west of Teakwood Lane to, and including, Evergreen Lane from, and including, 26t1' Avenue to 28t1' Place, excluding Medicine Lake Drive West and including 29th Avenue cul-de-sac east of Medicine Lake Drive West, and 26t1' Avenue and Campus Drive from Teakwood Lane to Northwest Boulevard; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held thereon the 22nd day of January, 2008, at which all persons desiring to be heard will be given an opportunity to be heard thereon, and WHEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes) since the project has not been petitioned for by the benefiting owners. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plymouth City Council of the City of Plymouth, Minnesota: I. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 2. Such improvement is hereby ordered as proposed in the Council resolution adopted January 22, 2008. 3. The Plymouth Engineering Department is designated as engineer for the improvement. They shall prepare plans and specifications for the making of such improvement. 4. The city council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of the tax exempt bond. Adopted by the City Council on January 22, 2008.
