RESOLUTION 2008-028
REVISING AND REPLACING RESOLUTION 97-214 APPROVING PRELIMINARY PLAT
AND PUD GENERAL PLAN FOR HOYT PROPERTIES, INC. FOR PROPERTY LOCATED
NORTH OF SCHMIDT LAKE ROAD AND WEST OF I-494 (97003)
WHEREAS, Hoyt Properties, Inc. has requested approval of a Preliminary Plat and PUD General
Plan for property legally described as follows;
Lot 2 and Lot 3, Block 1, Plymouth Technology Park, according to the plat thereof on file
and of record in the office of the Registrar of Titles, Hennepin County, Minnesota.
And
All that part of Lot 1, Block 1, Plymouth Technology Park, according to the plat thereof
on file and of record in the office of the Registrar of Titles, Hennepin County, Minnesota,
which lies easterly of Line A, described as follows: Commencing at the southeast corner
of said Lot 1; thence on an assumed bearing of South 89 degrees 58 minutes 47 seconds
West along the southerly line of said Lot 1 for 471.11 feet to the actual point of beginning
of said Line A; thence north 00 degrees 01 minutes 13 seconds West for 958.07 feet to the
northerly line of said Lot 1 and there terminating; Excepting therefrom all that part of said
Lot 1 lying westerly of a line parallel with and distant 245.00 feet easterly of Line A and
lying northerly of a line parallel with and distant 638.07 feet northerly from said southerly
line of Lot 1.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hoyt
Properties, Inc. for a Preliminary Plat and PUD General Plan, subject to the following conditions:

Approval of the Preliminary Plat and PUD General Plan are subject to the approval of the
Land Use Guide Plan Amendment and Rezoning.
2. A Site Plan is approved for two 25,721 square foot office/warehouse buildings, a 26,465
square foot office/warehouse building, 48,596 square feet office/warehouse building, and a
87,440 square foot office/warehouse building, according to the plans received by the City on
February 28, 1997.
3. A Preliminary Plat is approved for the creation of Lots 1-3, Block 1, Plymouth Technology
Park Second Addition.
4. The uses allowed in this PUD would consist of any permitted, accessory, conditional or
interim uses allowed in the I-1 Zoning District, plus on existing Lot 3 in the northeast portion
of the site, any permitted accessory, conditional or interim uses allowed in the I-2 Zoning
District as well.
5. Setback restrictions along the periphery of the property are as follows:
a) Front yard building setback of 50 feet
b) Side yard building setback of 15 feet
c) Rear yard building setback of 15 feet
d) Front yard parking setback of 25 feet
e) Side and rear yard parking setback of 15 feet
5. Except for Lots 2 & 3, Block 1, Plymouth Technology Park Addition, there shall be no
outside trash disposal facilities and restrictive covenants addressing this requirement shall be
filed with the Final Plat.
6. The building materials shall include natural colored brick on the front and side of the
buildings, with rockface block on the loading dock side. Uniform materials, signage, color
and architectural detailing will be enforced on each building. These requirements will be
verified prior to issuance of building permits.
7. Covenants regarding cross access, parking and fire access shall be submitted for staff review
and shall be filed with Hennepin County prior to issuance of building permits.
8. The developer shall be responsible for repairing any damage to the existing trail during
constriction. The trail may not be used for storage or access during constriction.
9. All rooftop and ground mounted mechanical equipment shall be designed (including exterior
color) and located so to be aesthetically harmonious and compatible with the building.
Rooftop equipment over three (3) feet in height shall be screened with durable materials which
are aesthetically compatible with the stricture. In no case shall wooden fencing be used as a
rooftop equipment screen.

10. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
c. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within twelve months of the date of this Resolution.
d. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
e. Compliance with the Ordinance regarding the location of fire hydrants, post indicator
valve, fire department connection, fire lanes, and fire lane signage.
f. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.
g. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the
dedication policy in effect at the time of building permit issuance.
h. The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnify the City
and its officers, employees, and agents for all costs, damages or expenses which the
City may pay or incur in consequence of such claims, including attorneys' fees.
i. No building permits shall be issued until the Final Plat is filed and recorded with
Hennepin County.
j. No building permits shall be issued until a contract has been awarded for constriction
of municipal sewer and water.
k. Submittal of required utility and drainage easements as approved by the City Engineer
prior to filing the Final Plat.
1. Compliance with regulations regarding handicapped parking spaces and access.
