RESOLUTION NO. 2008-025
AUTHORIZING THE VACATION OF
DRAINAGE & UTILITY EASEMENTS WITHIN COUNTY ROAD 6 FOR
MESSIAH UNITED METHODIST CHURCH PROPERTY
LOCATED AT 17805 COUNTY ROAD 6
WHEREAS, a public hearing with respect to said vacation was scheduled for January 8, 2008 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of January 8, 2008; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on January 8, 2008 to inform any and all interested
parties relevant to the vacation of drainage and utility easements within County Road 6 for Messiah
United Methodist Church property - 30-118-22-44-0001 ; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easements be vacated:
The north 10.00 feet of the West 640.00 feet of the Southeast Quarter of the Southeast
Quarter of Section 30, Township 118 North, Range 22, West, Hennepin County,
Minnesota lying southerly of the centerline of County Road No. 6. Together with the
east 10.00 feet, and the west 6.00 feet of the West 640.00 feet of said Southeast Quarter
of the Southeast Quarter of Section 30 lying northerly of the southerly right-of-way of
said County Road No. 6 and southerly of the centerline of County Road No. 6.

FURTHER, that said vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary
and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or
thereunder, to continue maintaining the same or to enter upon such way or portion thereof
vacated to maintain, repair, replace, remove, or otherwise attend thereof.
