HomeMy WebLinkAboutCity Council Resolution 2008-015CITY OF PLYMOUTH RESOLUTION NO. 2008-015 ACCEPTANCE OF STREETS FOR CONTINUAL MAINTENANCE STONE CREEK VILLAGE (2001073) WHEREAS, in accordance with the development contract dated January 29, 2003, Plymouth Leased Housing Associates, LLC., developer of Stone Creek Village (2001073), has agreed to install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below; and WHEREAS, the developer has requested a reduction of the required financial guarantee to reflect the completed work; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the financial guarantee requirements are reduced as follows: ITEM Street Constriction Sanitary Sewer Watermain Storm Sewer Boulevard and Drainage Swale Sod Rain Garden Constriction Mitigation Pond Constriction N [_]RP Pond Constriction Street Signs (I x 200) Park and Trail Improvements Site Grading and Drainage Improvements Setting Iron Monuments Design, Administration, Inspection, As- Bullts ORIGINAL CURRENT NEW AMOUNT AMOUNT AMOUNT $ 50,825 $ 12,800 $ -0- 12,380 -0- -0- 1,000 -0- -0- 27,100 -0- -0- -0- -0- -0- 10,500 10,500 10,500 9,450 9,450 9,450 25,760 6,440 6,440 200 -0- -0- -0- -0- -0- 123,500 6,175 6,175 750 750 750 31,376 -0- -0- $292,841 $46,115 $33,315 That the required financial guarantee for the above items be reduced as detailed above from $46,115 to $33,315 to reflect the completed work. Letter of Credit No. 170 may be reduced accordingly. Resolution No. 2008-015 Stone Creek Village (2001073) Page Two FURTHER BE IT RESOLVED that the financial guarantee requirements for the following items per Section 8.1 of the approved development contract remain as follows: ITEM Maintenance of Erosion and Sediment Control Plan, Street Sweeping, and Storm Sewer Cleaning Cash: ORIGINAL AMOUNT $ 9,000 NEW AMOUNT $9,000 FURTHER BE IT RESOLVED that the street constriction is accepted for continual maintenance as of January 8, 2008 subject to the one-year guarantee by the Developer per Maintenance Bond No. 105006307 issued by Travelers Casualty and Surety Company of America. Adopted by the City Council on January 8, 2008.
