HomeMy WebLinkAboutCity Council Resolution 2008-006CITY OF PLYMOUTH RESOLUTION 2008-006 APPROVING A PRELIMINARY PLAT AND FINAL PLAT FOR DUKE REALTY, L.P. FOR "MEDICINE -LAKE -BUSINESS PARK" FOR PROPERTY LOCATED AT 975 NATHAN LANE (2007107-F) WHEREAS, Duke Realty, L.P. has requested approval of a preliminary plat and final plat to plat the roughly 20 -acre site located at 975 Nathan Lane; and WHEREAS, the property is currently legally described as follows: That part of the Southwest Quarter of the Northeast Quarter of Section 36, Township 118, Range 22 described as beginning at a point on the North line of said Southwest Quarter of the Northeast Quarter distant 227 feet West from the Northeast corner thereof, thence South parallel to the East line of said Southwest Quarter of the Northeast Quarter, a distance of 226.5 feet; thence East parallel to said North line to an intersection with the West line of the East 17 feet of said Southwest Quarter of the Northeast Quarter; thence South along said West line of the East 17 feet to the South line of said Southwest Quarter of the Northeast Quarter; thence West along said South line to the Southwest corner of said Southwest Quarter of the Northeast Quarter; thence North along the West line of said Southwest Quarter of the Northeast Quarter to the Northwest corner thereof, thence East along the North line of said Southwest Quarter of the Northeast Quarter to the point of beginning; except that part thereof embraced within Registered Land Survey No. 1177, according to the Government Survey thereof, and except that part thereof which lies Southerly of a line 691.50 feet Southerly of, measured at a right angle to and parallel with the North line of said Southwest Quarter of the Northeast Quarter and lying Easterly of a line 506.91 feet Westerly of, measured at a right angle to and parallel with the East line of said Southwest Quarter of the Northeast Quarter. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. Resolution 2008-006 File 2007107 Page 2 NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Duke Realty, L.P. for a preliminary plat and final plat, subject to the following conditions: 1. The preliminary plat and final plat are approved in accordance with the plans received by the City on October 29, 2007, except as may be amended by this resolution. 2. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
