AN AMENDMENT RELATING TO PUBLIC HEALTH AND SAFETY;
AMENDING SECTIONS 615.03 AND 1135.03 OF THE PLYMOUTH CITY CODE.
THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS:
Section 1. The Plymouth City Code, Subsection 615.03, is
amended by adding a new subdivision to read:
Subd. 3. Exceptions. Sports and fitness clubs as
defined in the Plymouth Zoning Ordinance, Section 4,
Subdivision B are exempt from the licensing requirement
section.
Sec. 2. The Plymouth City Code, Subsection 1135.03 is
amended to read:
Massage Distinguished. The practice of massage is hereby
declared to be distinct form the practice of medicine,
surgery, osteopathy, chiropractic, physical therapy, or
podiatry. and Persons duly licensed in this state to
practice medicine, surgery, osteopathy, chiropractic,
physical therapy or podiatry, nurses or persons performing
therapeutic massages who work solely under the direction of
any such persons, athletic directors and trainers, or
persons employed in sports and fitness clubs as defined in
the Plymouth Zoning Ordinance, Section 4 Subdivision B are
hereby expressly excluded from the provisions of this
Section. Beauty culturists and barbers who do did not give,
or hold themselves out to give, massage treatments, as
defined herein, other than is customarily given in such
shops or places of business for the purposes of beautifica-
tion only, shall be exempt from the provisions of this
Section.
Sec. 3. This ordinance is effective on the date of its
publication in accordance with Subsection 110.11.
