HomeMy WebLinkAboutCity Council Ordinance 1989-38CITY OF PLYMOUTH ORDINANCE NO. 89-38 AN ORDINANCE AMENDING PORTIONS OF THE ORDINANCE 80-9 ADOPTED JUNE 16, 1980, AS AMENDED, AND KNOWN AS THE PLYMOUTH ZONING ORDINANCE, RELATIVE TO DEFINITION OF AND PROVISION FOR COMMUNITY-BASED FACILITIES. THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 4 is hereby amended, in part, as follows: Day Care facility - A care centers, ana day services. Dwelling, Attached -- A building where a Dwelling Unit is joined in a horizontal fashion to one or more ether Dwellings Units by party wall or walls. Dwelling, Detached -- A Dwelling Unit entirely surrounded by open space. Dwelling, Multiple Familv -- An Wilding attached dwelling designed for occupancy by three (3) or more families.. in Dwelling Units joined in a vertical and/or horizontal fashion Dwelling, 0" Single Family -- A building designed for and occupied exclusively by one (1) Family. person's home. 4 5. 6. 16 17 Senior (Elderly) Citizen Housing -- Multiple Family Dwellings which are designed, built, and operated for exclusive occupancy by persons who are at least b0 55 years old. Senior Citizen housing shall include certain ancillary facilities and special features associated with living needs for the comfort, health, safety, and welfare of elderly persons and which are not typically found in the construction of multiple family dwellings; such facilities and features shall include, but shall not necessarily be limited to, the following: Ramps and elevators in addition to, or in lieu of steps; non-skid floors; doors of sufficient width in all rooms to accommodate wheel chairs; electric cooking stoves only; showers, in addition to, or in lieu of tubs, for all dwelling units; electric outlets at levels at least 24 inches above the floor; grab bars around tubs, in showers, and around toilets, and railings in hallways; central heating; handle -type spigots and door knobs; emergency signal devices which ring in adjoining apartments, or at a central location; and, a multipurpose common room(s) or area adequate for social, meeting, and recreational activities of the residents. Section 8, Subdivision D, h. is hereby amended by the addition of the following: Community Correctional Facilities as regulated in Section 9. Adult Correctional Facility as regulated in Section 9 Section 5. Section 9 is hereby amended by the addition of the following: 1. Purpose City. Application requirements. b. Complete applications shall contain the following• 5 (4) The names and addresses on self-adhesive mailing labels of the owners of record of all property within 1.320 feet of the boundaries of the site as the same appear on the records of the Hennepin County auditor. The certified lists from the County shall be submitted. (5) Written verification of whether there are any Residential Facilities or Correctional Facilities licensed by the State of Minnesota within 1.320 feet of the subiect site at the time of application: if there are such facilities they shall be listed by address and type of facility. person or persons responsible during emergency including the address and telephone number where such persons may be reached 24 hours -a -day. 2. Development standards and performance criteria. licenses. b. On-site services and treatment at Residential Facilities and Correctional Facilities in residential districts shall be for residents and inmates of the facility only, and shall not be for nonresidents or persons outside the facility c. All new buildings or additions to existing buildings shall be consistent with the scale and character of the buildings in the neighborhood. Exterior building materials shall also be harmonious with other buildings in the neighborhood d. No Residential Facility and no Day Care Facility in excess of 16 persons shall be closer than 1,320 feet from another licensed facility. e. No Correctional Facility shall be closer than 1,320 feet from another licensed Correctional Facility or from any property designated on the Land Use Guide Plan as residential and/or designated on the approved zoning map as residential f. The Conditional Use Permit is only valid as long as a valid State license is held by the operator of the facility where such license is required. g Appropriate transition to neighboring property shall be provided by landscaping and site design consistent with the City ordinances and policies. Section 6. Effective Date. This ordinance shall take effect upon its passage and publication. Adopted by the City Council this 20th day of November, 1989.
