AN ORDINANCE RELATING TO PUBLIC HEALTH AND WELFARE;
AMENDING SECTION 705.29 OF THE PLYMOUTH CITY CODE
AND ADDING A NEW SECTION TO THE CODE.
THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS:
Section 1. Plymouth City Code, Subsection 705.29 is amended
to read:
705.29 Certain Uses of Sewers Prohibited. It is unlawful
to discharge or cause to be discharged any storm water,
surface water, ground water, roof runoff, subsurface drain-
age, cooling water or unpolluted industrial process waters
to any sanitary sewer unless a permit has been issued
pursuant to Section 715.15. It is unlawful to discharge or
cause to be discharged to any public sewer, any harmful
waters or wastes, whether liquid, solid or gas, capable of
causing obstruction to the flow in the sewers, damage or
hazard to structures, equipment and personnel of the sewer-
age works, or other interferences with the proper operation
of the sewage works. Violation of this Subsection is a
misdemeanor.
Sec. 2. The Plymouth City Code is amended by adding a new
subsection to read:
715.15 Winter Discharge Permits. In order to resolve
problems associated with the discharge of surface water from
sump pumps and footing drains during winter months, the City
Manager is authorized to issue a permit to allow a property
owner to discharge such surface water into the sanitary
sewer system. The permit shall authorize such discharge
only from November 15 to March 15 and a property owner is
required to meet at least one of the following criteria in
order to obtain the permit.
1. The freezing of the surface water discharge from the
sump pump or footing drain is causing a dangerous
condition, such as ice buildup or flooding, on either
public or private property.
2. The property owner has demonstrated that there is a
danger that the sump pump or footing drain pipes will
freeze up and result in either failure or damage to the
sump pump unit or the footing drain and cause basement
3. The water being discharged from the sump pump or
footing drain cannot be readily discharged into a storm
drain or other acceptable drainage system.
Sec. 3. This ordinance is effective on the date of its
publication in accordance with Subsection 110.11.
