HomeMy WebLinkAboutCity Council Ordinance 1991-39P.L ORDINANCE NO. 91-37 AN ORDINANCE RELATING TO PUBLIC HEALTH AND LICENSING OF ENTITIES COLLECTING RECYCLABLE MATERIALS; AMENDING SECTIONS 600 AND 1010 OF THE PLYMOUTH CITY CODE THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS: Section 1. The Plymouth City Code, Subsection 600.05 is amended to read. 600.05. Use of Licensed Collectors. Persons desiring to make use of the services of -licensed ^ -•�* collectors may do so by notifying such collector and paying the fees provided for in this Section. Sec 2. Plymouth City Code, Subsection 600.09, Subdivisions 1, 2 and 4 are amended to read: 600.09 License Required for Collectors. Subdivision 1. General Rule. It is unlawful for any person to collect garbage or recyclable materials without having first secured from the Council a license so to do. Subd. 2. License Required for Collectors. Any person desiring a license ------ garb shall make application for the same to the Clerk upon a form prescribed by the City. The application shall set forth: (a) the name and address of the applicant; (b) a list of the equipment which he proposes to use in such collection; (c) the place or places to which the garbage is to be hauled; (d) the manner in which sada-r-b� collected matter is to be disposed of; (e) the portion of the City in which collections are to be made; and (f) a detailed description of: (1) the manner in which the applicant intends to separately collect and haul away .yard waste; (2) the manner in which the applicant intends to account for the amount of such yard waste; and (3) the method by which the applicant will inform its customers of the yard waste collection program. If the application is approved by the Council, the applicant shall deposit with the Clerk a surety bond in form satisfactory to the City Attorney in the penal sum of $1,000 conditioned upon the faithful and continuous provision of the gauge collection service specified by the Council and under the conditions imposed by the laws of the City and the lawful orders, rules and regulations of the Health Officer. I£ such surety bond is approved by the Council, the Clerk shall issue and deliver the license. Sec. 3. The Plymouth City Code, Subsection 600.25 is amended by adding a new subdivison to read: Subd. 6. Reporting Requirements. Any licensed collector of recyclable materials must submit periodic reports as required by the City Manager describing the amount and type of recycling materials collected from multiple family dwellings and the location of such collection. Sec. 4. The Plymouth City Code, Subsection 1010.01,Subdivision 4 is amended as follows: Garbage.- Recyclable Materials and Refuse Haulers Sec 5.
