HomeMy WebLinkAboutCity Council Ordinance 1991-14CITY OF PLYMOUTH ORDINANCE NO. 91-/4k AN ORDINANCE AMENDING PORTIONS OF THE ORDINANCE 80-9 ADOPTED JUNE 16, 1980, AS AMENDED, AND KNOWN AS THE PLYMOUTH ZONING ORDINANCE, RELATIVE TO TEMPORARY PROMOTIONAL EVENTS AND SALES ACTIVITIES AND OUTSIDE STORAGE AND SCREENING OF OUTSIDE STORAGE THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 10, Subdivision C 6.c is hereby amended as follows: c. Temporary outdoor promotional and mereha sales activities directed at the general public may be allowed as an aeeessery us conditional uses, are subject to issuance of an administrative permit and au4jeet-te-the requirements of this paragraph. It is the intent of this paragraph to provide for temporary outdoor events and sales which are distinguished from permanent outside business activities that are allowed only by Conditional Use Permit approved by the City Council. (1). Application and Fee. (a) Application for an administrative permit for a temporary outdoor promotional or mewehandisiffg-sales activity, including licensed transient merchant and transient Droduce merchant sales, shall be made by the property owner to the Zoning Administrator on forms to be provided by the City at least 30 calendar days prior to the proposed event. (b) The application shall be eo signed by the fee owner ef the duration, and number of promotional events activities. A separate application shall b promotional events and for sales activities application shall be required each year. A shall be submitted for amendments to an iss specify the dates, or sales e reauired for lication ermit. (d) The application shall be accompanied by a non-refundable fee which shall be the fee established by the City Code for Conditional Use Permit applications. Applications for amending permits shall be accompanied by a nonrefundable fee which shall be the fee established by the City Code for Conditional Use Permit renewal aDDlications. -1- (2) Required Information and Plans. The application for either an administrative permit or for a transient merchant license or all be accompanied by t ng: (c) An accurate floor plan of any building on the property, when, in the judgment of the Zoning Administrator, such a plan is necessary to properly evaluate the location of the event and the effectiveness of building entrances and exits. (3) Procedure. (a) The Zoning Administrator shall review the -applications for administrative permits and for transient merchant and transient produce merchant licenses and related materials and shall determine that the proposal is in compliance with all applicable codes, ordinances, and the specific standards for temporary promotional and mewehaod s+rg-sales activities as set forth in this paragraph. The application shall also be reviewed by the Director of Public Safety. (b) A written permit shall be issued to the case of licensed sales activities. a written verification hen a determination of c conditions to assure ordinances, and the be attached to the permit. Temporary Outdoor Promotional Events include carnivals, craft shows, flea markets, mechanical and animal rides and displays of materials that are typically not sold or serviced on the site. ii. a. Promotional events shall not exceed the period specified in the Administrative Permit and in no case shall exceed three consecutive calendar days per event; two of the days shall be a Saturday and a Sunday. (b) Temporary Outdoor Sales Activities Definition. Temporary Outdoor Sales Activities include sidewalk sales, inventory reduction or liquidation sales, distressed merchandise sales, seasonal merchandise sales, and licensed transient merchant and transient produce merchant sales. ii. Standards. The following shall apply to all proposed temporary outdoor sales activities allowed by this paragraph and by City Code business licensing provisions in addition to other applicable building and safety code requirements as determined by the Zoning Administrator. - 2 - a. The maximum total time for temporary outdoor sales activities shall be the period specified in the Administrative Permit and, in no case, shall exceec 60 days per calendar year per property. b. There shall be no more sales activities than those specified in the Administrative Permit, and, in no case, shall there be more than 10 sales activities per year per property. (6) Administration and Enforcement. (a) The Zoning Administrator shall keep a record of applications and permits, including information from the City Clerk on licenses issued to transient merchants and transient produce merchants. (b) A copy of all permits issued shall be forwarded to the Director of Public Safety prior to the event or sale. Section 2. Section 8, Subdivision B is amended in part to read as follows: DISTRICTS USES B-1 B-2 B-3 Office Limited Retail Service 48. -A---- A A - Temporary outdoor promotional and mefekaffdi-s4-ng-sales activities as regulated in Section 10. Section 3. Section 4, Subdivision B is amended in part to read as follows: Storage, Outside -- Exterior depository, stockpiling, or safekeeping of materials, products, vehicles, trailers and the like. Outside storage may be enclosed by a structure that includes a roof in which case the structure shall be deemed outside storage; or outside storage may involve fencing or screening without a roof in which case fencing or screening shall be deemed outside storage. Outside storage does not involve any product representation or signage except for those emergency or safety related signs specifically approved by the City. Vending machines accessory to allowable uses do not constitute outside storage. Section 4. Section 8, Subdivision D 2.a. is amended in part as follows: a. Any permitted or accessory industrial use not conducted within a building including, but not limited to, outside storage of - materials, oduet as defined by this ordinance. - 3 - Section 5. Section 10, Subdivision C 4. is amended in part as follows: 4. Outside Storage and Display of ",—teals a. In all classes of Business District and the Industrial District, open outside storage of mals in any required front, side or rear yard shall be prohibited. b. Any other outside storage shall be located and screened per plan approved by the City so as not to be visible from any classes of Residence District, from adjoining property or from the public street. The screening of outside storage from adjoining propert and from the public street in the Business District and in the ustrial District may be waived totally or partially by the Ci ncil in conjunction with a Conditional Use Permit for the side storage. Section 6. Effective Date. This ordinance shall take effect upon its passage and publication. Adopted by the City Council this 6th day of May 1991.
