ORDINANCE NO. 93- 9
AN ORDINANCE RELATING TO SHADE TREE
DISEASE CONTROL
VII CITY COUNCIL OF' THE CITY OF PLYMOUTH ORDAINS:
Sec. 1. The Plymouth City Code, Subsection 2020.01, is amended
to read:
2020.01. PBrJjLLjjGQ11aC�� Policy. The City Council has determined
that the health of the shade trees within the ul�irl�e'XpX/City
limits iu threatened by shade tree diseases, It has further
determined that the loss of shade trees growing upon public and
private property would substantially depreciate the value of
proporty within the City and 'impair the safety, good order,
generalwelfare and convenience of the public. It is the
intont:ion of the Council to control and prevent the spread of
th so c'i.:ieas®s, and this Section is enacted for that purpose, and
to Conzo;�:n to the policies and procedures embodied in Minnesota

Sac. 2. The Plymouth City Cc de, Subsection 2020,02, Subds. 2, 3,
5, 6 and 7, are amended to read:

Subd. 6. "Disease Control Area" means the entire a s

Sec. 4. The Plymouth City Code, Subsection 2020.05, is amended
to read:
2020.05. Tg}gl Disease Program. It is the intention of the
Council of the City of Plymouth to conduct aI
Ogrogram �SAtaf}i�d�/%Yah/�ar[i!xrbi/pursuant to the aut ority granted
by Minnesota Statutes 1$.023, as amended. This program is
directed specifically at the control and elimination of g,,hade I
free Apiseases and is undertaken at the recommendation of the
Comnissonexrl�;f/kejY��YYiSY�, and in conformance with rules I
promulgated by the Commissioner. The City aY��/fr1g�$dYaSz I
qF shall act as coordinator between the Commissioner Of I
Xf gkjAAAYxIYj5/and the Council in the conduct of this program. I
Sec. 5. The Plymouth City Code, Subsection 2020.07, is amended
to read:
2020.07. kkadit— j-ua&as. Subdivision 1. Nuisances
The following things are public nuisances whenever
they, may be found within the City:
(f:) Any living or standing elm tree or part thereof
infected to any degree with the Dutch elm disease

which the bark has not been removed and burned or
sprayed with an effective elm bark beetle insecticide.

(d) Any tree or shrub which in the opinion of the 2fYy I

premlooN at any reasonable time for the purpose of carrying out
any of the duties assigned hi her under this Section, Such
insnecti.ons shall be preceded by a legal notice published once
annually in the City's legal newspaper informing all property
ownero within the City to destroy and dispose of tree materials
declared a nuisance by Section 2020.07.
Subd. 3. Dj agnosia. The tTree iinspector shall identify
disoased trees according to generally accepted field diagnosis
procedures such as wilting, yellowing of leaves and/or staining
of cambial wood under tree bark, Confirmation of field
diagnosis, when ordered by the TfHH/Xr1H e#dtr6x/ shall be
completed by a Tree Disease laboratory approved by the Minnesota
Sec. 7. The Plymouth City Code, Subsection 2020.11, is amended

procedures as may be established by the Commissioner of
Agriculture.
Sec. 8, The Plymouth City Code, Subsection 2020.13, is amended
to read:

Subdivision 1. Findings. Whenever the Yjree 1jnspector finds
with reasonable certainty that the infestation defined in

the nuisance will be abated within a specified time,

Md. 2. $ecorda. The 3aifSpBd di/ shall keep a
record of the costs of abatements orders under this Subsection
and shaj.l. report JrXIAIXY/to the City Council all work done for
which amsessments are to be made stating and certifying the
description of the land, lots, parcels involved and the amount
chargonble to each.
,Md. 3. Kati�_iiearinct. The Council shall publish notice
of its intention to meet to consider the adoption of a special
assoasmeat roll in accordance with the report provided by the
tXsi3/X�i=,r�irdx The notice shall be mailed to affected
property owners an published once no less than one week prior to
such meeting. The notice shall state the time and place of the
meeting, the properties affected, action proposed, and the
estimated coat of the abatement, and the proposed basis of
aamassment, if any, of costs. At such hearing or adjournment
thereof, the Council shall hear property owners with reference to
the proposed assessments. The Council shall thereafter adopt a
resolution confirming the original resolution with such
modification as it considers for the levy of special assessments.
Subd. 4. &1UaaxMaaL. Following the public hearing provided
for in Subd. Q., the Council may then spread the charges or any
portion thereof against the property involved as a special
anseoNm€ent under �i rtri�ddy /g x( rfl'�k/BdCl/�Z�l%RIX/�rtd/eS�kl
pertinent §JAJg.ntwtutes for certification to the County Auditor
and collection the following year along with current taxes.
sec. 9. The Plymouth City Code, Subsection 2020.15, is amended
to read:

Sec. 10, The Plymouth City Code, Subsection 2020.19, is amended
to read:

hi64QL agents while they are engaged in the performance of
dutlas imposed by this Section.
Sec. 11. This Ordinance is effective upon passage.
