HomeMy WebLinkAboutCity Council Ordinance 1994-21ORDINANCE NO. 94- 21 AN ORDINANCE RELATING TO CHILD ENDANGERMENT THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS: Sec. 1. The Plymouth City Code is amended to include a new Section 945 to read: 945.01. General Rule. A parent, legal guardian, or caretaker who causes or allows a child under the age of five (5) to remain unattended in a motor vehicle, when that parent, legal guardian, or caretaker was in a position to provide supervision for the child, or was reasonably able to remove the child from the motor vehicle, is guilty of child endangerment. For purposes of this ordinance, it is not a defense that the parent, legal guardian, or caretaker maintains visual contact with the child while the parent, legal guardian, or caretaker leaves the vehicle unattended; and it is not a defense that the parent, legal guardian, or caretaker leaves within the motor vehicle another child under the age of ten (10) to supervise the child. A caretaker is anyone age sixteen (16) or older who assumes or has responsibility for the welfare of the child left in the motor vehicle. 945.03. Violations. Violation of this Section shall be a misdemeanor. Sec. 2. This ordinance is effective upon its passage in accordance with Section 110.11.
