HomeMy WebLinkAboutCity Council Ordinance 1995-27CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 95- 27 AN INTERIM ORDINANCE TEMPORARILY PROHIBITING CERTAIN PLATS THE CITY OF PLYMOUTH ORDAINS: SECTION 1. Background. 1.01. The City is concerned that industrial and commercial development will have an adverse effect on adjacent residential development unless changes to the City's official controls are adopted. 1.02. The City has not comprehensively reviewed the official controls for the area in over fifteen (15) years. 1.03. There are a number of significant land use issues including: a) The purpose, desired character, and location requirements of the various commercial and industrial land use classifications identified by the City's Comprehensive Plan. b) Commercial and industrial zoning classifications and the permitted, conditional, and accessory uses to be allowed in each of the districts, including the possibility of establishing new zoning classifications or eliminating current zones. c) The appropriate planning and zoning classifications of existing and future commercial and industrial land, with special emphasis on the highway corridors. d) Establishing appropriate development standards for commercial and industrial uses, including but not limited to: standards for conditional uses; setbacks and lot coverage; building height and bulk; landscaping, yard, and buffering requirements; parking lot design and 24355 r05/03195 minimum parking requirements; building materials and colors, and outside storage and display. e) Reviewing and revising the application requirements and procedures for review of site plans, general development plans, conditional use permits and planned unit development plans. fj Updating the Subdivision Code to ensure that it is consistent with the Zoning Ordinance requirements and procedures, and with current practice and requirements for subdividing land and constructing infrastructure. g) Reviewing the Transportation Element of the Comprehensive Plan, including an examination of the thoroughfare plan and the need for accesses and interchanges in the two major highway corridors. 1.04. There is a need for a study to be conducted so that the City can adopt a set of comprehensive official controls pertaining to such uses and issues. The study will address the land use issues, including those referenced above. 1.05. The City Council hereby directs that such a study be undertaken by the City's Planning Department. 1.06. There is a need for an interim ordinance for the purpose of protecting the planning process and the health, safety and welfare of the citizens of the City. There is a need to restrict such uses until the study has been completed and any modifications to the City's official controls are accomplished. 1.07. Minnesota Statutes § 462.355, Subd. 4 (1994) permits the adoption of an interim ordinance during the planning process. SECTION 2. Definitions. The following terms whenever used in this ordinance shall be interpreted to mean: 24355 _2_ r05/03/95 Commercial or industrial guided property: Property guided as follows under the Land Use Guide Plan in the City's Comprehensive Plan: CL Limited Business CS Service Business CR Retail Shopping CC Community Center IP Planned Industrial Commercial or industrial zoned property: Property with the following zoning district classifications: B-1 Office Limited Business District B-2 Shopping Center Business District B-3 Service Business District I-1 Planned Industrial District. M.P.U.D. Mixed Use Planned Unit Development Official Controls: City plans and ordinances which control the physical development of the City including the City's Comprehensive Plan, zoning ordinance, and subdivision ordinance. Plat: The drawing or map of a subdivision prepared for filing of record pursuant to Minnesota Statutes Chapter 505 (1994) and containing all elements and requirements set forth in applicable Plymouth city ordinances adopted pursuant to Minnesota Statutes Section 462.358 and Chapter 505 (1994). SECTION 3. Temporary Moratorium. Pending the completion of the above referred to study and adoption of appropriate official controls, no plat for land zoned commercial or industrial or guided commercial or industrial, shall be approved and no application for such approval will be accepted. This ordinance shall not apply to plats which have previously been preliminarily approved by the City Council or to active applications for plat approval submitted prior to the effective date of this ordinance. 24355 r05/03/95 -3- SECTION 4. Enforcement. The City may enforce this ordinance by injunction or any other appropriate civil remedy in any court of competent jurisdiction. SECTION 5. Separability. Every section, provision or part of this ordinance is declared separable from every section, provision or part of this ordinance. If any section, provision or part of this ordinance is adjudged to be invalid by a court of competent jurisdiction, such judgment shall not invalidate any other section, provision or part of this ordinance. SECTION 6. Duration. This ordinance shall take effect upon its approval by the City Council and shall remain in effect until the date of the adoption of the official controls contemplated hereunder or November 1, 1995, whichever occurs first.
