HomeMy WebLinkAboutCity Council Ordinance 1995-14CITY OF PLYMOUTH ORDINANCE NO. 95- /4 AN ORDINANCE AMENDING THE ZONING ORDINANCE REQUIREMENTS FOR DRIVE THROUGH BUSINESSES AND LOADING AREAS THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 4, Subdivision B is hereby amended by amending the following definitions as indicated: Drive Throuah Business A drive through business is a business that by design physical facilities, service or by packaging procedures encourages or permits customers to receive services, obtain goods or be entertained while remaining in their motor vehicles, excluding gasoline service stations as defined in this subdivision. Loading Area A loading area is an off-street space berth or dock used for the loading or unloads of cargo, products or materials from trucks or trains. Section 2. Section 10, Subdivision B, 5.j. and 5.1. shall be amended as follows: 5. Design of Parking, and Loading, and Drive Through Facilities: L Requirements for Loading Areas 1) Any non-residential structure which has an aeareeate gross floor area of 10.000 square feet or more shall be provided with off-street truck loading or unloading berths of at least twelve (12) feet in width fourteen (14) feet in height, and sixty (60) feet in length in accordance with the following schedules Where.a side loading berth is to be utilized such berth shall not be less than twelve (12) feet in width nor less than sixty-five (65) feet in length In no instance shall any designated side loading berth encroach upon a fire lane or driving aisle. (a) All maneuvering for off-street loading areas shall be accomplished on privaterp opeM. (b) Retail. (3) Loading areas established after (effective date of the r ordinance) are prohibited within 300 feet of residentially zoned or guided property unless completely screened bv_ an intervening building Loading areas not requiring screening by an intervening building shall be screened from adjacent residential zoned or guided property by the use of berms fences or walls to provide 100 percent opacity to a height of at least ten feet. (4) Loading areas shall not be located within the required front side or rearward building setback area. 1 Requirements for Drive-through Businesses (1) These facilities shall be located only on sites having direct access to a minor arterial street collector or service road. (2) All portions of businesses with drive through facilities established after (effective date of the ordinance), including but not limited to the building in which they are located, service windows and queuing spaces shall be Y. (2) All portions of businesses with drive through facilities established after (effective date of the ordinance), including but not limited to the building in which they are located, service windows and queuing spaces shall be located across an arterial or collector street from residentially zoned orug ided property or shall be set back at least 300 feet from residentially zoned oriug ded property. (3) The public address system shall not be audible from any adjacent residentially zoned or guided property (4) Businesses with one drive through lane shall provide queuing space for at least ten vehicles, and businesses with two or more drive through lanes shall provide queuing space for at least six vehicles per lane as measured from and including the last pick-up station window, or the like Oueuing spaces shall not interfere with parking spaces or traffic circulation (5) The applicant shall demonstrate that such use will not significantly lower the existing level of service on streets and intersections. (6) Alcoholic beverages shall not be sold or served (7) All elements of the drive through service area including but not limited to menu boards, order stations teller windows, and vehicle fights from the queuing lanes shall be screened from adjacent residentially zoned oriug ded property by the use of berms fences or walls to provide . 100 percent opacity to a height of at least six feet Section 3. Effective Date. This ordinance shall take effect upon its passage and publication.
