ORDINANCE NO. 95-9
AN ORDINANCE AMENDING CHAPTERS 1 AND 5 OF
THE PLYMOUTH CITY CODE AND THE ZONING ORDINANCE
CONCERNING NOTIFICATION REQUIREMENTS
THE CITY OF PLYMOUTH ORDAINS:
Section 1. Section 105 of the Plymouth City Code is amended to add subsection 23 as
follows:
105.23. Public Hearings and Public Meetings. Subdivision 1. Distance for
Notification Requirements. Where property owners within a specified distance of
the boundaries of property which is the subject of a public hearing or a public
meeting must be notified of the hearing or meeting, the distance shall be measured
from the property line of the subject property, excluding railroad and street rights-
of-way that immediately abut the subject property.
Subd. 2. Failure to Give or Receive Notice. Failure of a property owner
to receive notice shall not invalidate the procedure. Notice requirements in
addition to that required by state statute are directory only. Failure to provide
such notice shall not invalidate the proceeding.
Section 2. Section 500.05 of the Plymouth City Code is amended to read:
Subd. 3. Public Hearing. Copies of the proposed plat shall be furnished
to the Planning Commission, which shall hold a public hearing on the proposed
plat in accordance with the provisions of Minnesota Statutes, Section 463.358, as

recommendations with respect to such proposed plat to the Council.
Section 3. Section 500.41 of the Plymouth City Code is amended by adding Subdivision
3 as follows:
Subd. 3. Public. A public meeting shall be scheduled before the
Planning Commission on all applications for any variance under this Subsection
so that the public has an opportunity to express its views on a proposed variance.

At least ten days before the date of the meeting, a written notice shall be mailed
to the applicant and to all owners of property located within one hundred (100)
feet of the boundaries of the property which is the subject of the application.
Section 4. Section 11, Subdivision A of the Plymouth Zoning Ordinance is amended to
read:
A site plan shall be reviewed by the Planning Commission and approved
by the City Council, before building permits are issued for the
development or alteration of structures and before development or
redevelopment of sites commences on any property in the City except for
Agriculture permitted in the FRD Districts and except as otherwise

Section S. Section 11, Subdivision A is amended by adding Paragraph 14 to read as
follows:
14. Public Hearings and Public Meetings.

Section 6. Section 11, Subdivision C, Paragraph 3 of the Plymouth Zoning Ordinance
is amended to read:

establish a time and place for a hearing before the Board. At least ten
days before the date of the hearing, a written Notice of Hearing shall be

Administrator shall provide a copy of the application and related materials
to the Board prior to the scheduled meeting.
Section 7. Section 11, Subdivision C, Paragraph 4 of the Plymouth Zoning Ordinance
is amended to read:
ADOPTED this 7th day of February 1995, by the City Council of the City of
Plymouth.
