Open house set for June 18 on Highway 169 Triangle
construction in Brooklyn Park, Osseo
ROSEVILLE, Minn. — The Minnesota Department of Transportation invites the public
to learn about reconstruction of the Highway 169 Triangle in Brooklyn Park and Osseo
during an open house on Wednesday, June 18. The open house will be held from 3
p.m. to 6 p.m. at Brooklyn Park City Hall, 5200 85th Ave. N. in Brooklyn Park.
The meeting will provide an opportunity for the public to learn about upcoming
construction, staging and detour information. Displays illustrating the work and future
alignments will be available. Representatives from Mn/DOT and the cities of Brooklyn
Park and Osseo will be in attendance to answer questions.
Reconstruction of the Highway 169 Triangle begins in July. The project will
rebuild the intersections of Highway 169, Hennepin County Road 81 and 85"' Avenue
to upgrade the condition of the highway, improve its safety, reduce congestion and
increase its capacity to meet the needs of the driving public.

METROPOLITAN COUNCIL NOTICE OF PUBLIC HEARING TO
CONSIDER ADJUSTMENTS TO REGIONAL TRANSIT FARES
The Metropolitan Council will hold a series of public hearings to consider
adjusting transit fares, effective October 1, 2008. If adopted, the changes
would help the regional transit system respond to rapidly rising fuel costs
and lower -than -anticipated state revenues from the Motor Vehicle Sales Tax.
Revenues from fare adjustments would help address a projected shortfall of
nearly $15 million in 2009 and anticipated shortfalls in the next biennium.
Adjustments considered at the hearings would apply to fares on all routes
operated by regional transit providers, including Metro Transit, suburban
and contract providers, Metro Mobility and Dial -a -Ride services. Please note
that in Plymouth, this would only affect fares for Plymouth Metrolink, not
Plymouth Dial -A -Ride. The City of Plymouth controls fares for Plymouth Dial -
a -Ride independent of the Metropolitan Council.

3 sentenced for distributing methamphetamine
Methamphetamine is one of the most popular illegal drugs in Minnesota, according to the
Hazelden Foundation, and federal officials continue to stop those distributing this dangerous and
addictive drug. The last of three defendants charged together in a conspiracy involving
methamphetamine were sentenced last week.
Patrick Wayne Jarmuzek, 36, Minneapolis, was sentenced to 70 months in prison and five
years of supervised release June 5 in Minneapolis by United States District Court Judge John
Tunheim. Jarmuzek was sentenced on one count of conspiracy to distribute and possess with
intent to distribute methamphetamine.
Two other defendants connected to this case were recently sentenced by Judge Tunheim.
Michael Dale Ackley, 38, Minneapolis, was sentenced to 80 months in prison and five years of
supervised release on March 27, and Shawn Gerald Holmquist, 22, Robbinsdale, was sentenced
to 12 months and one day in prison and four years of supervised release on May 22. Both were
sentenced on one count of conspiracy.
All three defendants were indicted on April 24, 2007. Ackley pleaded guilty on July 31,
Holmquist pleaded guilty on June 8 and Jarmuzek pleaded guilty on Feb. 29, 2008.
According to their respective plea agreements, the three knowingly and intentionally
conspired with each other to possess with the intent to distribute, and to distribute in excess of 50
grams of the highly addictive and dangerous drug methamphetamine from Jan. 1, 2007, to March
29, 2007.
According to a Drug Enforcement Administration (DEA) affidavit, the Northwest Metro
Drug Task Force began investigating Jarmuzek in January 2007, after learning he was selling
quantities of methamphetamine in the Minneapolis area.
Officers observed a Feb. 5, 2007, meeting at an apartment complex located on Pillsbury
Avenue in Minneapolis, where a purchase was discussed involving Jarmuzek and Holmquist.
Police arranged a "controlled buy" with Jarmuzek on Feb. 5 at a coffee shop located on Lyndale
Page 9
Avenue in Minneapolis, involving 1 ounce of methamphetamine.
On March 29, police arranged for another "controlled buy" at a Target store, located at
Interstate 35W and Johnson Street in Minneapolis. Officers observed Holmquist providing 1
ounce of methamphetamine as part of the "controlled buy."
Police conducted a traffic stop on Jarmuzek's vehicle while he was driving with Holmquist
March 29 near the intersection of Interstate 35W and Washington Avenue in Minneapolis. Both
Jarmuzek and Holmquist were arrested, and during a search of the vehicle, officers recovered
drug paraphernalia and approximately 2 grams of methamphetamine.
The total weight of the methamphetamine recovered by officers during the investigation was
approximately 58 grams.
This was the result of an investigation by the Northwest Metro Drug Task Force, the DEA
and the police departments of Minneapolis and Plymouth, and was prosecuted by Assistant U.S.
Attorneys Michael A. Dees and Andrew S. Dunne.

been completed. The findings will be sent to
those that commented the week of April 21st.
The DNR will have wetland jurisdiction over
approx. 80% of the site, WCA for the rest. The
LISACOE will also have wetland mitigation
requirements. Westwood is preparing the
wetland replacement plan application. There are
discussions with BARR Eng regarding a
feasability study for the Plymouth Creek stream
restoration project which may be able to be used
for part of the wetland replacement re uir ment.

1. BACKGROUND: The Police Department conducts two rounds of compliance checks each
year for licensed alcohol and tobacco establishments.
2. DISCUSSION: The Police Department has completed the first round of compliance checks
for 2008. The failure rate for licensed liquor establishments was slightly higher then last
year. Licensed tobacco establishments failure rate remained the same.
In the first round of checks we had five failures out of the 57 we completed for licensed
liquor establishments. That 9% failure rate compares with a 7% failure rate for last year.
We had three failures in the 42 checks we completed for tobacco license holders. This 7%
failure rate is the same as we had last year.
Dino's Pizza has gone out of business and the Holiday Station store on Hwy 55 is no longer
selling alcohol.
Arkady's Market is no longer selling tobacco products, and the Snyder Drug on Lancaster is
no longer in business.
So far we have collected $2,500 for violations from compliance checks this year. We expect
to receive an additional $500 in penalties where an administrative hearing has yet to be heard.
License holders have served 10 days of suspension for these violations.

In April, 2008, we received an inquiry about the current use of a number of units at your
Stone Creek at Medicine Lake apartments located at 1020 W. Medicine Lake Drive,
Plymouth, MN 55441. The inquiry asked if the current use of these units was legal in the
City of Plymouth and at this facility. As with every inquiry, we performed a preliminary
inspection and review and outline our findings below.
On May 2, 2008, we met with representatives from Ometta Vent Care, Inc. and their
attorney to better understand the business of Ometta Vent Care, Inc., what services they
provide and who their customers were. Although they were reluctant to tell us much
about the business, they did agree to allow us to inspect a number of the units they
currently rent from you. Our purpose of this inspection was to review the use and
determine whether it complies with City Code and State Building and Fire Codes.
Based on our inspection of the units, done on May 6, 2008, it is our preliminary
determination that the units currently leased by Ometta Vent Services to house critical
care patients are an institutional occupancy. If this is correct, this building would need to
be classified as an I-2 Occupancy rather then the current classification Stone Creek now
has which is an R-2 Occupancy. As a part of our continued review of the current use of
these units by Ometta Health Care Services and the governing codes, we made contact
with both the Minnesota Department of Health and the State Building Codes and
Standards Division of the Minnesota Department and Labor. Both agencies indicated
that they are also investigating the current use at your Stone Creek facility.
We continue to review the outlined activities and other potentially similar uses at Stone
Creek. Given the nature of the uses, our investigation is expected to take several
additional weeks to complete. In the meantime, please call with any questions. If you

Association of Metropolitan Municipalities
Metro Cities Legislative Policy Committees
The following committees annually develop policy based on input from member city
representatives. The committees submit their policy recommendations to the Board for review,
modification and distribution to the general membership. The membership meets in November
before each legislative session to debate and adopt the Metro Cities' policies. Sign-up on back
Metropolitan Agencies
Considers legislative issues and other policies related to the Met Council and metro agencies and
monitors the structure and relationship between the regional and local units of government. It
has developed policy in the areas of land use planning, solid waste management, the Met Council
selection process, livable communities, water supply and inflow and infiltration. It also reviews
the council's yearly budget.
Municipal Revenues
Considers any matter concerning city revenues, property taxes and city expenditures, including
state aid formulas and dollars, levy limits, property tax relief programs, property tax assessments
and fiscal disparities.
Housing & Economic Development
Considers all issues related to economic development and housing, including affordable housing
and activities of the metro HRA (Housing and Redevelopment Authority). It also develops policy
dealing with economic development issues, HRAs, TIF (Tax Increment Financing), and
development authorities. Recently, policies have been developed in the areas of eminent
domain, mortgage foreclosures, and Met Council housing targets.
Transportation & General Government
Considers all issues related to transportation, including funding sources at all government levels,
and issues which have impact on metropolitan area cities outside the scope of other Metro Cities
committees. Metro Cities' members of the Transportation Advisory Board (TAB) and Technical
Advisory Committee (TAC) are encouraged to join, along with other city officials. This
committee has developed policy on the metro sales tax, photo enforcement of traffic laws,
municipal consolidation, pensions, PELRA, comparable worth, data privacy, contractor licensing
and local control/authority.

Notice of Release
The Minnesota Pollution Control Agency (MPCA) has been informed that a release has occurred or contamination
has been encountered from storage tanks and/or storage tank facilities that you own and/or operate. The MPCA
appreciates your timely notification so this site can be handled in an efficient manner.
Legal Obligations
Federal and state laws require that persons legally responsible for storage tank releases notify the MPCA of the
release and/or discovery of contamination, investigate and, if necessary, clean up the release(s)/contamination. A
person is considered legally responsible for a petroleum tank release if the person owned or operated the tank
either during or after the release, unless specifically exempted under the law. For releases of other substances, a
person is considered legally responsible if the substance discharged was under the control of the person at the time
of the discharge or release or if the person was an owner or operator of the storage tanks and/or tank facility at the
time the release occurred. If you believe that you are not legally responsible for this storage tank facility release,
please contact the project manager listed below.
Request to Take Corrective Action
The MPCA requests that you take steps to investigate and, if necessary, clean up the release(s)/contamination in
accordance with the enclosed MPCA fact sheets. The site investigation must fully define the extent and magnitude
of the soil and/or ground water contamination caused by the release(s)/contamination. For petroleum release sites,
the MPCA has facts sheets that will help you or your consultant properly investigate the release and report the
results to the MPCA. Unless your site is considered "high priority" (see below), you must submit a report to this
office which details the results of the investigation or concludes that excavation was sufficient to clean up the
release within 10 months of the date of this letter. The MPCA reserves the right to reject proposed corrective
actions if the requirements of the site investigation have not been fulfilled. Refer to the following web site for
related guidance documents and information, http://www.pca.state.mn.us/programs/lust_2.httnl. For sites
contaminated by pollutants other than petroleum, the MPCA requests that you or your consultant contact the
MPCA project manager listed to discuss the investigation and reporting timeline that will be required for your site.
The MPCA considers sites with "free product" (free-floating petroleum), that have affected or that threaten to
affect drinking water supplies, sites where pollutants are being released to surface waters such as lakes or
wetlands, sites where petroleum or other vapors have been detected within structures or that pose fire or explosion
hazards, to be high priority for staff review. If one or more of these situations apply to your petroleum or non -
petroleum facility, a Remedial Investigation/Corrective Action Design report (refer to guidance documents) must
be submitted within 90 days. The MPCA reserves the right to reject proposed corrective actions if the
requirements of the site investigation have not been fulfilled. In addition, if you know or discover that there is free
product in a well, excavation, or borehole, you must notify the MPCA within 24 hours and IMMEDIATELY begin
interim free product recovery (refer to guidance documents). If you have any question with regard to whether your
site is "high priority" please contact the MPCA project manager listed below.

Reimbursement for petroleum sites:
In 1987, the legislature established the Petroleum Tank Release Compensation Fund (Petrofund) to reimburse some
responsible persons and volunteers (property owners not responsible for releases) who take corrective action for a
portion of their costs. The Petrofund is administered by the Petroleum Tank Release Compensation Board (Petro
Board), which is part of the Minnesota Department of Commerce. If the release at your site is a petroleum release,
the MPCA encourages you to learn more about the Petrofund reimbursement program by contacting Petrofund staff
at 651/215-1775 or 1/800-638-0418 (in greater Minnesota only), or by reviewing the information that is available at
the following website, http://www.pca.state.nmt.us/programs/lust_p.html. Because there are rules governing eligible
costs of cleanup, the MPCA strongly encourages you to familiarize yourself with the enclosed proposal and invoice
forms and the other program requirements in order to maximize the available reimbursement. Please note that final
decisions regarding the amount of reimbursement are made by the Petro Board, not the MPCA.
If you have not already done so, the MPCA recommends that you hire a qualified environmental consulting firm to
help you investigate and clean up the contamination on your site. To be qualified, the consultant should have
experience in performing investigations of contaminated sites and in developing and implementing corrective
actions. For petroleum investigations, the consultant must be registered with the Petro Board if you wish to have
your costs considered for reimbursement. A list of registered contractors is available from the Petrofund staff.
Please note that. under the Petro Board's rules, (see Minn. R. ch. 2890), you must solicit a minimum of two written
competitive ensu!tan! proposals on a form prescribed by the Petro Board to incur costs eligible for reimbursement,
and a minimum of two written competitive contractor bids must also be obtained for each contractor service.
Again, the MPCA strongly encourages you to contact Petrofund staff for answers to al l of your questions about
bidding and the other Petrofund reimbursement program requirements.
Required Response
The MPCA requires that you respond to this letter within 30 days to indicate whether you intend to proceed with
the requested work. If you do not respond within this time frame, the MPCA will assume that you do not intend to
comply, in which case the MPCA Commissioner may issue you an enforceable order that will require you to take
corrective action. Failure to cooperate with the MPCA in a timely manner may result in reduced reimbursement
from the Petro Board, see Minn. R. ch. 2890. If you do not cooperate, the MPCA has the option of taking the
corrective actions on your behalf and recovering its costs from you.
