HomeMy WebLinkAboutCity Council Resolution 2024-130 C ITY OF P LYMOUTH R ESOLUTION N O. 2024-130 R ESOLUTION A PPROVING A C ONDITIONAL U SE P ERMIT FOR S TEDDY, LLC DBA I NNER A CTIVE P LAYGROUND, FOR P ROPERTY L OCATED AT 14600 28 TH A VENUE (2024016) WHEREAS, Steddy, LLC, dba InnerActive Playground, has requested approval of a conditional use permit to allow an indoor commercial recreation use in the I-2 (light industrial) zoning district at 14600 28th Avenue; and WHEREAS, the subject site is presently legally described as follows: Lot 7, Block 1, Circle Star Business Center Third Addition, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Steddy, LLC, dba InnerActive Playground, for a conditional use permit to allow an indoor commercial recreation use in the I-2 (light industrial) zoning district at 14600 28th Avenue, subject to the following conditions: 1. The requested conditional use permit is hereby approved in accordance with the application and plans received by the city on February 29, 2024, with additional information on March 4, 2024, except as may be amended by this resolution. 2. The requested conditional use permit is approved with the findings that all applicable conditional use permit standards would be met, as outlined in the zoning ordinance. 3. A building permit is required prior to commencement of the project. 4. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Plans, specifications, and a building code analysis will need to be prepared by a MN licensed architect. b. Provide an updated site plan that shows accessible parking spaces and access aisles. c. The accessible routes (max slope 1:20) needs to be identified on the plans from the accessible parking spaces to the accessible entry. d. Provide an accessible route such as an elevator will need to be provided to access 2nd level. e. Sewer Availability Charge (SAC) determination letter will be required. f. The restrooms will need to meet 2020 Minnesota accessibility code. g. Building code related items will be addressed at building permit application submittal. Resolution 2024-130 2024016 Page 2 h. Property owner shall check to see if there is a cross-access easement or agreement with properties to east and south. 5. If the city determines that there is a parking shortage on the site at any point in the future, the business owner shall stripe up to 14 additional parking spaces (as determined by the city) on the site. This shall be an administrative approval. 6. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 7. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. b. Ensure fire lanes are maintained and drive isles kept clear. c. The site shall remain in conformance with section 2025 of the city code regarding noise regulations. d. Compliance with the city’s lighting regulations. e. All signage shall require separate permits and shall be in conformance with the sign regulations in section 21155 of zoning ordinance. f. Compliance with city’s landscaping regulations. g. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21015.07, respectively, of the zoning ordinance.
