HomeMy WebLinkAboutCity Council Resolution 2024-104 C ITY OF P LYMOUTH R ESOLUTION N O. 2024-104 R ESOLUTION A PPROVING A P RELIMINARY P LAT FOR S AI B RINDA, LLC FOR “S ILVER B UCKLE D EVELOPMENT” FOR P ROPERTY L OCATED AT 16700 C HANKAHDA T RAIL (2023068) WHEREAS, Sai Brinda, LLC has requested approval of a preliminary plat for roughly 10.6 acres of land presently legally described as follows: The North half of the Northwest quarter of Section 5, Township 118, Range 22 except the west 2,278 feet thereof, as measured along the north line and south line of said North half, according to the United States Government survey thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Sai Brinda, LLC for a preliminary plat for Silver Buckle Development, subject to the following conditions: 1. A preliminary plat is approved for 22 single-family lots, in accordance with the plans received by the city on October 9 and 25, 2023, and additional information on November 17, 2023, and December 14, 2023, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site. 3. Prior to commencement of grading operations, the developer shall 1) provide a wetland impact plan and complete the Wetland Conservation Act process for any wetland impacts, 2) clean-up and receive approval by the Minnesota Pollution Control Agency for the removal of the construction debris as identified in the Phase I and II Environmental Site Assessments and 3) install and request inspection of tree preservation fencing and silt/erosion control fencing. 4. Prior to recording the final plat, the developer shall: a) Remove the existing structures 16700 Chankahda Trail and obtain any required demolition permits prior to the removal of those existing structures. b) Receive approval of final construction plans including compliance with city and watershed regulations regarding drainage and water quality. c) Revise the landscaping plan to meet both the reforestation requirements and landscaping requirements pursuant to section 21130.03, subd. 2 of the zoning ordinance. d) Provide a separate recordable easement for the proposed gravel access road on Lot 7. e) Execute the development contract and provide the related financial guarantees and fees. f) Obtain Minnesota Pollution Control Agency, Metropolitan Council Environmental Services, Minnesota Department Of Health and National Pollutant Discharge Elimination System permits. Resolution 2024-104 (2023068) Page 2 g) Obtain any necessary Hennepin County and Elm Creek Watershed approvals and permits. h) Revise the plat to rename the north/south public street to Everest Lane North and the east/west street to 60th Place North. i) Pay the required park dedication and tree restitution fees. 5. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a) File and record the final plat with Hennepin County. b) Install and request inspection of tree protection fencing and silt fencing. c) Complete grading operations and provide a grading certificate as certified by the licensed project engineer. d) Install and certify the placement of the wetland buffer monuments per the approved grading plan. e) Provide a certificate of survey indicating a minimum of two front yard trees to be planted, one of which must be an overstory tree. One front yard and one rear yard tree will be permitted on the narrower lots where two trees would not be feasible in the front yard. f) Provide a disclosure statement to the buyers of Lots 9 and 10 regarding the likelihood of the future extension of the public street and of them becoming corner lots in the future. g) Remove the temporary cul-de-sac turn-around, including restoration of the disturbed area with sod and irrigation system, on the property located at 16620 60th Place within the Steeple Hills subdivision east of the subject property. h) The lowest floor elevation must comply with the 1.5-foot higher than the emergency overflow elevation requirement. 6. The developer shall notify potential buyers about the future westerly roadway extension of 60th Place North and install a sign to notify passersby that the street will be extended in the future. 7. Upon submission of the final plat application, the developer shall submit: 1) homeowner’s association documents for city review. The homeowner’s association documents shall address: responsibilities for maintenance and repair of developer-installed retaining walls, sidewalks, and any subdivision signage. They shall also address the shared maintenance of the existing secondary access from Chankahda Trail to Comstock Lane, within the Steeple Hills subdivision to the east, until a new secondary access is created by extension of the public street to the west, through the Elm Creek subdivision; 2) a construction phasing plan which will include temporary access to Chankahda Trail with construction traffic measures (i.e. signs, cones, etc.). 8. The developer shall provide any necessary easements for a gravity sanitary sewer system to be installed and connected across the undeveloped property to the west. In addition, the necessary access agreement for the city to access the property to the west for maintenance of the public sanitary sewer pipe shall be submitted and approved by city staff. 9. Vehicular driveway access is denied from the southernmost lots (Lots 4-6, Block 1) to Chankahda Trail, making the yard areas between the rear of the homes on those lots and Chankahda Trail an “equivalent” yard. Resolution 2024-104 (2023068) Page 3 10. Secondary access for the development is hereby waived. Note that secondary access (via future westerly extension of 60th Place North) would be provided when the property to the west is subdivided in the future. 11. Standard Conditions: a. No building permits, including those for a model home, shall be issued until the final plat is filed and recorded with Hennepin County and the streets and utilities are installed. b. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. c. Any signage shall require separate permits and shall comply with the city’s sign regulations. d. The sidewalks shall be installed at the same time the streets are installed. e. Submit fire flow calculations with the final plat application. f. Retaining walls are not permitted in drainage and utility easements. g. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a minimum 42-inch high fence shall be installed at the top of retaining walls that exceed four feet in height. h. Compliance with the city’s tree preservation, reforestation, and restitution regulations. i. Removal of all hazardous trees at the owner's expense. j. No trees shall be planted in the boulevard. k. This approval shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the landowner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
