HomeMy WebLinkAboutCity Council Resolution 2024-091 C ITY OF P LYMOUTH R ESOLUTION N O. 2024-091 R ESOLUTION A PPROVING A S ITE P LAN FOR S CHMIDT W OODS P ARK P ROPERTY L OCATED AT 4825 H OLLY L ANE (C ITY OF P LYMOUTH, 2024012) WHEREAS, the City of Plymouth has requested approval of a site plan for the construction of a new city park, Schmidt Woods Park, and related site improvements at 4835 Holly Lane North, legally described as follows: Outlot P, Hollydale, Hennepin County, Minnesota. And The west 200.00 feet of the east 513.05 feet of the north 208.70 feet of the south 740.00 feet of the northwest quarter of the southwest quarter of section 8, township 118, range 22; also that part of the east 513.05 feet of said northwest quarter of the southwest quarter lying north of the south 740.00 feet and south of the southerly right of way line of the Minneapolis, St Paul and Sault St. Marie railroad, except the east 33.00 feet thereof taken for county road 74, and except the following described tract: beginning at the intersection of a line drawn parallel with and distant 33.00 feet west of the east line of said northwest quarter of the southwest quarter, and a line drawn parallel with and distanct 790.00 feet north of the south line of said northwest quarter of the southwest quarter; thence westerly parallel with the south line of said northwest quarter of the southwest quarter 248.64 feet; thence deflect to the left 50 degrees 12 minutes 17 seconds 88.79 feet to its intersection with a line drawn parallel with and distant 338.05 feet west of the east line of said northwest quarter of the southwest quarter; thence southerly parallel with said east line 190.68 feet to the south line of the north 208.70 feet of the south 740.00 feet of said northwest quarter of the southwest quarter; thence easterly parallel with said south line of the north 208.70 feet of the south 740.00 feet, 305.46 feet to a line drawn parallel with and distant 33.00 feet west of the east line of said northwest quarter of the southwest quarter; thence north 258.67 feet along said 33.00 foot parallel line to the point of beginning, Hennepin county, Minnesota And that part of the northwest quarter of the southwest quarter of section 8, township 118, range 22, described as follows: beginning at the intersection of a line drawn parallel with and distant 33.00 feet west of the east line of said northwest quarter of the southwest quarter, and a line drawn parallel with and distanct 790.00 feet north of the south line of said northwest quarter of the southwest quarter; thence westerly parallel with the south line of said northwest quarter of the southwest quarter 248.64 feet; thence deflect to the left 50 degrees 12 minutes 17 seconds 88.79 feet to its intersection with a line drawn parallel with and distant 338.05 feet west of the east line of said northwest quarter of the southwest quarter; thence southerly parallel with said east line 190.68 feet to the south line of the north 208.70 feet of the south 740.00 feet of said Resolution 2024-091 File 2024012 Page 2 northwest quarter of the southwest quarter; thence easterly parallel with said south line of the north 208.70 feet of the south 740.00 feet, 305.46 feet to a line drawn parallel with and distant 33.00 feet west of the east line of said northwest quarter of the southwest quarter; thence north 258.67 feet along said 33.00 foot parallel line to the point of beginning, Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by City of Plymouth a site plan, for the construction of a new city park and related site improvements, subject to the following conditions: 1. A site plan is approved to allow the construction of Schmidt Woods Park and related site improvements, in accordance with the plans received by the city on February 2, 2024 and February 23, 2024. 2. A separate building permit is required prior to the commencement of the project. 3. A separate electrical permit is required prior to the installation of the light poles and fixtures. 4. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Obtain city approval of final construction plans, including any stormwater requirements. b. Obtain any necessary watershed permits. 5. Standard Conditions: a. Silt fence shall be installed prior to any construction on the site. b. All retaining walls over four feet shall require issuance of a building permit and a 42-inch fence installed on top of the wall. c. Any signage shall receive separate sign permits and comply with section 21155 of the zoning ordinance. d. Any new proposed exterior lighting fixtures shall meet current zoning ordinance standards pursuant to section 21105.06 of the ordinance. e. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. f. The site plan amendment, conditional use permits shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09, and 21015.07, respectively, of the zoning ordinance.
