HomeMy WebLinkAboutCity Council Resolution 2024-056 C ITY OF P LYMOUTH R ESOLUTION N O. 2024-056 R ESOLUTION A PPROVING A H OME O CCUPATION L ICENSE FOR D ANIEL M AKEPEACE TO OPERATE A B ASKETBALL T RAINING B USINESS OUT OF THE HOME LOCATED AT 1315 O AKVIEW L ANE (2023091) WHEREAS, Daniel Makepeace has requested approval of a home occupation license to operate a basketball training business out of the home located at 1315 Oakview Lane North; and WHEREAS, the subject property is legally described as Lot 5, Block 8, Beacon Heights First Addition, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Daniel Makepeace for a home occupation license at 1315 Oakview Lane North, subject to the following findings and conditions: 1. The home occupation license is approved for a basketball training business, known as Pure Intensity Basketball, in accordance with the application and plans received by the city on December 7, 2023, and additional information on December 12, 2023, except as amended by this resolution. 2. Compliance with section 21145 of the zoning ordinance, relating to home occupations. 3. The applicant must meet the following standards: a) The home occupation shall be clearly incidental and secondary to the residential use of the premises, shall not change the residential character of the neighborhood, and shall not result in a disturbance to the surrounding uses. b) There shall be no use of equipment that would cause electrical interference to surrounding properties. c) On-street parking shall not be used for parking demand. The applicant shall use the driveway to accommodate parking demand associated with the home business. d) There shall not be any exterior storage of equipment or exterior signage used in the home occupation. e) Less than 25 percent of the gross floor area of the home shall be used for the home occupation. f) No person other than those who reside in the home shall be employed on the premises. g) There shall be not more than ten one-on-one client appointments per day upon the premises. Group sessions shall not be permitted. h) The home occupation shall not be conducted between the hours of 10:00 pm and 7:00 am. Resolution 2024-056 (2023091) Page 2 4. The existing exterior sign associated with the business and signage on the protective pads shall be removed prior to any business activity. Any logos or signage/branding associated with the business visible from the street shall not be permitted. 5. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. 6. The home occupation license is valid for one year from the date of approval. The home occupation license may be issued for a period of one year after which the license may be reissued for periods of up to three years each by the Zoning Administrator.
