HomeMy WebLinkAboutCity Council Resolution 2024-044 C ITY OF P LYMOUTH R ESOLUTION N O. 2024-044 R ESOLUTION A PPROVING A S ITE P LAN, C ONDITIONAL U SE P ERMITS AND V ARIANCES FOR P ROPERTY L OCATED AT 5805 P EONY L ANE AND 5720 P EONY C OURT (ISG I NC., C ITY OF P LYMOUTH -- 2023081) WHEREAS, ISG Inc. on behalf of the City of Plymouth has requested approval of a site plan, conditional use permits, and variances for the construction of a new city park – The Meadows Playfield and modifications to The Meadows Park with related site improvements, at 5805 and 5720 Peony Lane, legally described as follows: The East 659.69 feet of the South Half of the Northeast Quarter of Section 6, Township 118 North, Range 22 West of the 5th Principal Meridian, Hennepin County, Minnesota. And Outlot B Enclave on the Greenway, Hennepin County, Minnesota And Outlot D Enclave on the Greenway, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by ISG Inc., on behalf of the City of Plymouth, for a site plan, conditional use permits, and variances for the construction of a new city park – The Meadows Playfield and modifications to The Meadows Park with related site improvements, subject to the following conditions: 1. A site plan is approved to allow the construction of three pickleball courts, two tennis courts, a cricket pitch field with two overlapping soccer fields with athletic lighting, winter ice skating and sledding, restrooms, picnic shelters and a parking lot and related site improvements, in accordance with the plans received by the city on November 10, 2023, December 7, 2023, December 11, 2023, December 13, 2023, and December 15, 2023, except as amended by this resolution. 2. A conditional use permit is approved to allow an outdoor recreation use in the FRD (future restricted development) zoning district with the finding that the proposal complies with all applicable conditional use permit standards. A conditional use permit is approved to allow athletic lighting that does not comply with the lighting district 2 (LZ2) regulations with the finding that the proposal complies with all applicable conditional use permit standards. 4. A variance is approved to allow a structure setback of zero where 100 feet is required, with the finding that the proposal complies with all applicable variance criteria. 5. A variance is approved to allow a retaining wall setback of zero where three feet is required. 6. A variance is approved to allow a parking lot setback of zero where 20 feet is required, with the finding that the proposal complies with all applicable variance criteria. 7. A variance is approved to allow a drive aisle setback of zero where 20 feet is required, with the finding that the proposal complies with all applicable variance criteria. 8. A separate building permits is required prior to the commencement of the project. 9. A separate electrical permit is required prior to the installation of the light poles and fixtures. 10. A separate building permit is required for the ten-foot-high fencing enclosing the courts. 11. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Obtain city approval of final construction plans, including any stormwater requirements. b. Obtain any necessary Elm Creek Watershed permits. 12. Standard Conditions: a. Silt fence shall be installed prior to any construction on the site. b. All retaining walls over four feet shall require issuance of a building permit and a 42-inch fence installed on top of the wall. c. Any signage shall receive separate sign permits and comply with section 21155 of the zoning ordinance. d. Any new proposed exterior lighting fixtures shall meet current zoning ordinance standards pursuant to section 21105.06 of the ordinance. e. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. f. The site plan amendment, conditional use permits shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09, and 21015.07, respectively, of the zoning ordinance.
