FOR P ROPERTY L OCATED AT 2515 M AGNOLIA L ANE N ORTH (2023080) WHEREAS, CUBE, Inc. has requested approval of variances to lot area and lot width to allow construction of a new home on a vacant lot in the RSF-1 zoning district; and WHEREAS, the variances would allow construction of a new home and related site improvements on a non-conforming lot that contains 10,385 square feet where 18,500 square feet is the minimum area required and contains 66 feet in width where 110 feet is the minimum lot width required in the RSF-1 zoning district; and WHEREAS, the subject property is legally described as That Part of Lot 3, Block 3, Elmhurst Gardens, Lying South of the North 1 Foot, Front and Rear, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by CUBE, Inc. for lot area and lot width, for 2515 Magnolia Lane North, subject to the following findings and conditions: 1. The requested variances are hereby approved, in accordance with the application and plans received by the city on November 9, 2023, and additional information on December 5, 2023, except as may be amended by this resolution. 2. The requested variances are approved, based on the finding that all applicable variance standards have been met. Specifically, a. The requested variances for a new single-family home are consistent with the residential uses listed for this land use classification in the comprehensive plan. b. The applicant has demonstrated that there are practical difficulties in complying with the ordinance regulations, because: 1. the request is reasonable, and the property would be used in a reasonable manner and would result in a new single-family home in the RSF-1 zoning district; 2. the request is due to circumstances not created by the landowners as the lot created in 1914 does not meet the minimum area and width requirements for the RSF-1 zoning district; and 3. the variances would not alter the essential character of the lot or neighborhood as the lot is in character with the surrounding lots within the subdivision and contained a single- family home from the years 1948 to 2015. c. The requested variances are not based upon economic considerations, but rather, are based upon the unique characteristics of the property and the request to add a home on the previously platted lot. The requested variances and resulting construction would not be detrimental to the public welfare, nor would it be injurious to other land or improvements in the neighborhood. The applicant is requesting the variances to be able to build a single-family home on a previously platted lot that fits the character of the neighborhood. e. The requested variances and resulting construction would not impair an adequate supply of light and air to adjacent properties, nor would it increase traffic congestion or the danger of fire, endanger the public safety, or substantially diminish property values within the neighborhood. The requests are consistent with the uses in this zoning district and the proposed home would increase the value of this lot. f. The variances requested are the minimum action required to address the practical difficulties and that the proposed home would meet all other zoning regulations. 3. A building permit is required prior to commencement of the project. 4. Prior to issuance of the building permit, the applicant shall submit a revised certified survey that identifies 1) the location of either at least two existing preserved and protected trees or two new, to be planted, front yard trees, or a combination thereof, pursuant to zoning ordinance requirements and 2) drainage arrows directing stormwater toward Magnolia Lane away from the adjacent properties. 5. In conjunction with issuance of the required building permit, the applicant shall identify and mark the lot line corners. 6. The variances shall expire one year after the date of approval, unless the property owner or applicant has commenced the authorized improvement or use, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21030.06 of the Zoning Ordinance.
