HomeMy WebLinkAboutCity Council Resolution 2024-020 C ITY OF P LYMOUTH R ESOLUTION N O. 2024-020 R ESOLUTION A PPROVING P RELIMINARY AND F INAL P LAT, S ITE P LAN, AND C ONDITIONAL U SE P ERMIT FOR E AGLE B ROOK C HURCH FOR PROPERTY LOCATED AT 17910 C HANKAHDA T RAIL (2023 065) WHEREAS, Eagle Brook Church has requested approval of a preliminary and final plat, site plan, and conditional use permit to establish two lots and allow construction a new 64,000 square foot church building that seats 1,500 people and has 685 parking spaces for the roughly 53-acre site located at 17910 Chankahda Trail and presently legally described as follows: Parcel 1: The East 682 feet of the Northeast Quarter of the Northeast Quarter of Section 6, Township 118 North, Range 22 West of the 5th Principal Meridian, EXCEPTING 1.25 acres heretofore conveyed to School District No. 120, Hennepin County Minnesota; situated in the Southeast corner of the Northeast Quarter of the Northeast Quarter of said Section 6, by deed, in Book 115 of Deeds, on Page 217, and by deed from William Dolan and Lydia Dolan his wife, to School District 120, dated November 15, 1933. Parcel 2: The West 643 feet of the East 1325 feet of the North Half of the Northeast Quarter of Section 6, Township 118 North, Range 22 West of the 5th Principal Meridian. Parcel 3: The West 258 feet of the East 1841 feet of the North Half of the Northeast Quarter of Section 6, Township 118 North, Range 22 West of the 5th Principal Meridian. Parcel 4: The West 258 feet of the East 1583 feet of the North Half of the Northeast Quarter of Section 6, Township 118 North, Range 22 West of the 5th Principal Meridian. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the aforesaid preliminary and final plat, site plan, and conditional use permit for Eagle Brook Church for property located at 17910 Chankahda Trail, based upon the analysis contained within the related staff memos and exhibits attached thereto, all related meeting minutes and any and all materials distributed at the meetings (all of which are hereby incorporated herein by reference), including the following findings and subject to the following conditions: Resolution 2024-020 File 2023065 Page 2 1. A preliminary and final plat is approved to subdivide the site into two lots; one lot for the church and one lot to be dedicated as city park land, in accordance with plat drawings received by the city on September 14, 2023, except as may be amended by this resolution. 2. Approval of the preliminary and final plat is contingent upon approval of the request to rezone the site from FRD (future restricted development) to RSF-3 (single family detached 3). 3. The site plan is approved in accordance with the plans received by the city on September 14, 2023, with revised plans received on November 3, 2023 and a revised landscaping plan received on November 30, 2023, except as may be amended by this resolution. 4. A conditional use permit is approved to allow church use of the site in accordance with the detailed staff analysis findings, as listed in the Planning Commission report. 5. Prior to recording of the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Provide an easement to the city in recordable form for the trailway that would extend from the parking lot to the southeast corner of the site. This easement must be recorded with the final plat. b. Execute a site improvement performance agreement (SIPA) for the public and private improvements and provide the related financial guarantees and fees. c. Provide the city with a warranty deed free and clear of any and all encumbrances for Lot 2 (the park land to be dedicated). 6. Building permits are required prior to commencement of the project. 7. Prior to issuance of any grading or building permits, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Obtain city approval of final construction plans. b. Install silt fence prior to any grading or construction work on the site. c. Obtain any required permits and/or approvals from the Elm Creek Watershed District. d. Obtain approval of the storm water pollution protection plan (SWPPP) and of a national pollutant discharge elimination system (NPDES) permit, if required. e. Provide a storm water maintenance agreement in recordable form for the drainage system. f. Provide evidence that any existing septic systems and wells on the site have been properly abandoned and sealed in accordance with the regulations of Hennepin County and the Minnesota Department of Health. g. The maximum slope of five percent (1:20) for accessible routes must be identified on the plans from accessible parking spaces to the accessible building entrance. h. Required permanent wetland buffer and park monument signs shall be installed. Resolution 2024-020 File 2023065 Page 3 8. Implementation of the traffic study recommendations are the responsibility of the applicant, and are hereby incorporated into the approval, as follows: a. Existing striping shall be modified to formalize a northbound left-turn lane into the site. b. A southbound right-turn lane on Maple Grove Parkway (to enter the site) shall be installed to reduce potential conflicts with vehicles entering the site from the south. c. The driveway exit from the site shall be designed with two exit lanes that are at least 225 feet long. The north exit lane shall be for drivers turning left onto Maple Grove Parkway or continuing straight onto 61st Avenue, and the south exit lane shall be for drivers turning right onto Maple Grove Parkway. d. At the discretion of police department, a traffic control officer shall be provided during Sunday morning peak periods to assist drivers at the Maple Grove Parkway intersection with the church driveway/61st Avenue. e. The applicant shall work with the police department to develop a traffic control management plan. 9. The applicant shall construct the city trail within the trail easement and, upon its satisfactory completion, the city shall reimburse the applicant for the cost of the trail installation. 10. The applicant shall remove the temporary cul-de-sac turn-around located in the southeast portion of property located at 18120 61st Avenue. Upon installation of the permanent cul-de-sac turn- around for that street, the applicant shall restore that area including installation of soil and sod. 11. The applicant shall enter into an agreement with the city to allow use of a portion of the church parking lot as overflow parking for The Meadows Park playfield site. 12. The fire lane (emergency access route) coming off the new permanent 61st Avenue cul-de-sac turn- around in the west portion of the site shall be cordoned off to general traffic, in a manner as approved by city staff. 13. The applicant shall work with the City Clerk’s office to allow the site as a possible polling (voting) location for primary and general elections. 14. Added conditions stemming from the January 9, 2024 City Council approval: a. Prior to commencement of the project, the plans shall be revised to incorporate a right-in/right- out driveway connection along the north side of Chankahda Trail to provide vehicular access between Chankahda Trail and the church parking lot, in a location and with a design as approved by staff. The applicant shall be responsible for the costs related to this access connection. b. Prior to commencement of the project, the applicant shall work with staff to revise the building elevations (architectural design and materials) in a manner that provides a more aesthetically pleasing and softer appearance that fits in with the residential surroundings, additional articulation, additional windows, and similar treatments on all sides of the building, as approved by staff. Prior to commencement of the project, the applicant shall work with staff to identify and address areas where additional and/or relocated landscaping and potentially other screening methods (e.g., berms, privacy fencing, hedge rows) would help to block headlights from abutting properties, as approved by staff. 15. Standard Conditions: a. Any signage shall comply with Section 21155 of the zoning ordinance and shall receive prior approval of sign permits. b. Any visible rooftop or ground-mounted mechanical equipment shall be painted or screened to match the building. c. Compliance with the city’s lighting regulations. d. Compliance with all fire and building code requirements. e. The applicant would need to repair any damage that occurs to existing trails abutting the site, in accordance with city standards. f. The applicant shall remove any diseased or hazardous trees. g. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. h. The approvals shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 510, 21045.09 and 21015.07, respectively, of the city code.
