Minneapolis City Assessor Patrick J. Todd, who maintains his northeast Minneapolis fixer -upper was valued at far more than it was worth when he bought it, is seeking a refund of part of his 2009 taxes by appealing to the Minnesota Tax Court. That's right: He's going to court to contest a value set by the office he heads. Ironic? Maybe, but for Todd, the city's assessor since 2005, appealing a disputed assessment just like any other taxpayer "is honoring the system as it was designed." "It's one of those properties where the owner never called [the assessor's office] to say the value was too high," he said. Todd bought the two-bedroom, one -bath home as investment property from an estate in July 2008 for $90,000. On Jan. 1, 2008, the home had been assessed at $166,500 with a tax bill for payable 2009 of $2,239. MI Page 1 of 3 GET THE LATEST NEWS. Todd said he knew the assessment was too high when he bought the house, a couple of months after it had been on the market. The owner had died after living in the house since 1951. The 61 -year-old rambler, at 3305 NE. Arthur St., was built of concrete block and still had the original furnace, plumbing and electrical components. The 804 -square -foot house had a single detached garage, no basement and no central air conditioning. Because of those unique drawbacks, the house didn't fit the property model on which assessments are based, Todd said. And the homeowner failed to alert the city that it was valued higher than it should have been.. "We're trying to do the best job we can," Todd said. "If you don't agree with us, you've got to call us." City assessors don't regularly set foot on every property every year. Assessment is done through Computer -Assisted Mass Appraisal, which bases values on neighborhood and sales. "They do the best they can," real estate lawyer Bob Hill said of city assessors. They can't do property by property; they can't be that precise." Normally, a taxpayer unhappy with an appraisal would call Todd's office as the first step. If the owner and a deputy assessor talked and couldn't reach agreement, then he or she could appeal to the Board of Appeal and Equalization. Because Todd bought his house after the books were closed for payable 2009, his only option was to file with the court, though he said he wouldn't have brought it to his department anyway, because of his conflict of interest. Todd's property was last viewed by assessors from the outside in 2006, when it was valued at $188,000, he said. In January 2008, the house was assessed during what real estate agents said was the slowest January in more than a decade for Twin Cities home sales. In Minneapolis, sales continued to fall through June 2008, just before Todd bought the house. But he said it didn't lose value during that time, it was just a bad assessment. He installed wallboard and worked on the plumbing, heating and electrical systems, he said. He is trying to sell the refurbished house for $164,900, but there haven't been many nibbles. Phil Krinkie, president of the Taxpayers League of Minnesota, said that Todd's situation reflects his belief that assessments often unfairly outpace market values_ "Assessors are artificially keeping valuations high so their [political] bosses don't have to raise taxes as much to get the same revenue for their budgets," Krinkie said, Todd said that because of his position, assessors with Hennepin County rather than the city are reassessing the home. They also will explain or defend their assessment when the matter is heard in state Tax Court on March 19. Todd said the assessors have visited the home, but have not provided him yet with their valuation, He figures the tax refund, if he gets it, would amount to $700 or $800. He said that like most people, he believes the sale price reflects the property's value. Tax lawyer Nicholas Furia, who handles property tax appeals for commercial buildings, conceded that assessors are like all property taxpayers. "If their jurisdiction makes an error, they have a right to appeal," he said. Mayor R.T. Rybak's chief of staff, Jeremy Hanson Willis, had limited information about Todd's appeal but said he is "a professional, ethical member of our leadership team who takes great care in being transparent." Lisa Daniels, executive director of the International Association of Assessing Ulcers in Kansas City, Mo., said Todd's appeal, which appears on a public tax court docket, shows he didn't try to interfere in the process. "It seems he's doing everything right by the books and not going privately to his staff people," she said. Real estate lawyer Hill said: "It is funny. I'm sure he's going to get teased, but he's doing what any taxpayer should do." CALL TO ORDER — 7:02 P.M. 2. PUBLIC FORUM Andy Polzin introduced himself to the EQC and explained that he is in attendance at the EQC meeting as an observer. The EQC in turn, introduced themselves to Mr. Polzin. 3. APPROVAL OF AGENDA The agenda for the November 18, 2009, EQC meeting was approved with the addition of a neighborhood meeting announcement by Water Resources Manager Asche, 4. PUBLIC INFORMATION ANNOUNCEMENTS Chair Osborne reported that Councilmember Black was awarded the Recycling Association of Minnesota Public Service Award in October. She said since most of Councilmember Black's work is in the City of Plymouth, it was decided that she also needed to be recognized by the EQC and was presented an award certificate. Chair Osborne noted that Wesli Waters, a former EQC student member, was awarded the Floyd Forsberg Environmental Quality Scholarship by the Solid Waste Association of North America. S. CONSENT AGENDA A. PUBLIC HEARING — There was no public hearing scheduled for the ineeting. 7. GENERAL BUSINESS A. EQC WORK PLAN Water Resources Manager Asche reported that the City Council established the EQC in 1994 and refined its objectives in 2002 and in 2007 through a mission statement. He said the EQC's current concentration is on compliance with federal, state, regional and local regulations, the review of city policies and ordinances, and recommendations of environmentally related actions to the City Council. Water Resources Manager Asche stated that in January of each year, the EQC submits a proposed work plan to the City Council for their review. He referred to the draft EQC Schedule of Activities for 2010 and asked the EQC to review and continent on the document for use at the joint meeting with the City Council on November 30, 2009. The following additions and changes were made to the draft 2010 Schedule of Activities for the EQC: • Addition of the 2009 Annual Report and 2010 Work Plan to the January 13, EQC meeting • Addition of 2010 Education Activities Preview to the February 10, EQC meeting • Delete the 2010 Education Activities Preview and add Federal Stimulus Funding for Energy Conservation from the April 14, EQC meeting • Addition of Solid Waste and Recycling (organics collection, trash hauler licensing ordinance review, organized trash collection and recycling contract) to the May 12, EQC meeting • Addition of Bird Safe and Lights Out programs to the June 9, EQC sleeting • Addition of a discussion of waste water treatment to the August 11, EQC meeting • Addition of a discussion of drinking water treatment to the September 13 EQC meeting • Addition of the Lake Pepin and Upper Mississippi River/Bassett Creek Impaired Biota TMDL as "Other TMDL's" • Addition of "Other Activities" including Yard and Garden Expo, Environmental Quality Fair and Music in Plymouth 8. REPORTS AND STAFF RECOMMENDATIONS A. MEDICINE LAKE TMDL UPDATE Water Resources Manager Asche reported that the report is currently in pre -draft form. He said a public information meeting was held at the end of October and the steering committee meetings are done. A draft form will be distributed to the steering committee members and then Page 11 Environmental Quality Committee Minutes November 18. 2009 Page 3 returned to the Pollution Control Agency (PCA). The PCA will then make changes and issue a draft for public comment. B. BASS-SCHMIDT-POMERLEAU TMDL UPDATE Chair Osborne asked if there is anything the EQC needs to review before the public information meeting on December 9, 2009. Water Resources Manager Asche replied that the implementation plan and TMDL will be posted on the City's website and included in the next EQC meeting packet. C. PLYMOUTH CREEK STREAM BANK RESTORATION UPDATE Water Resources Manager Asche reported that this streambank restoration project is located from 26`x' Avenue North to West Medicine Lake Park, He explained that the primary method will be a natural type solution with a portion of the creek proposed for rerouting to prevent flooding of properties by Medicine Lake. Three proposals have been received from engineering consulting finns. A reconnnendation awarding the contract to Wenck Associates, Inc. will be made to the City Council at the November 24, 2009. City Council meeting. In December or early January a public information meeting will be held with the residents along the creek. D. NEIGHBORHOOD MEETINGS Water Resources Manager Asche informed the EQC of two neighborhood meetings on November 19, 2009. He stated that the first meeting is at 6:00 p.m. for the 41" Ave. Goldenrod / Mission View neighborhood located in Ward 3 and the second meeting is at 7:30 p.m. for the Wild Wings neighborhood which is in Ward 4. He explained that the Wild Wings neighborhood is located north of Schmidt Lake Road and cast of Zachary Lane and includes three large wetlands with potential flooding hazards due to cattail build-up in the center of the wetlands. He said the City has a permit from the Department of Natural Resources (DNR) and is proposing to connect storm sewer pipes to open water areas in the wetlands. 9. For your information, the put -pose of the preliminary engineering report is to determine, in a preliminary manner, the feasibility of reconstructing and resurfacing existing streets within a proposed project area. This report is developed based on the comments received from the informational meeting and the existing conditions. After the informational meeting, the City received the soil boring results from AECOM, USA, which shows what the existing soils arc under the pavement. AECOM states that while the roadway surface is in very poor condition, the material underlying the roadway is suitable and structurally sound, and that we may want to consider a mill and overlay as an option. Staff will be meeting with pavement experts to further analyze South Shore Drive to determine if a mill and overlay is a viable option, or if reconstruction is needed. Once a determination is made, the preliminary engineering report will be prepared. We anticipate having this report completed in January, 2010 and the Public Hearing in February, 2010. This would still provide sufficient time to construct the project in 2010, if the project does proceed. You will receive notification inviting yort to the Public Hearing, at which time you will receive an estimated assessment based on the preliminary engineering report recommendations.
