Regular City Council Meeting
August 22, 2023
Mayor Wosje called a Regular Meeting of the Plymouth City Council to order at 7:00 p.m. in the Council
Chambers of City Hall, 3400 Plymouth Boulevard, on August 22, 2023.
COUNCIL PRESENT: Mayor Wosje, Councilmembers Willis, Davis, Peterson, Pointner, and Gregor.
COUNCIL ABSENT: Councilmember McGregor.
STAFF PRESENT: City Manager Callister, Deputy City Manager Solano, Public Safety Director Fadden, Fire
Chief Coppa, Director of Public Works Thompson, Deputy Public Works Director/City Engineer LaBounty,
Community and Economic Development Director Fernelius, Park and Recreation Director Tomlinson,
Human Resources Director Timpone, Finance Director Rich, Planning and Development Manager
McGuire, Management Intern Nwachi, City Attorney Mattick, and City Clerk/Administrative Coordinator
Gallup.
Plymouth Forum
There was no one to speak at the forum.
Presentations and Public Information Announcements
Mayor Wosje requested a moment of silence to honor past Mayors of Plymouth who had recently
passed away and noted two of Plymouth’s legislators, Representative Klevorn and Senator Rest, were
honored by the League of Minnesota Cities as 2023 Legislators of Distinction.
Approval of Agenda
Motion was made by Councilmember Peterson, and seconded by Councilmember Willis, to approve the
agenda. With all members voting in favor, the motion carried.
Consent Agenda
Motion was made by Councilmember Willis, and seconded by Councilmember Pointner, to adopt the
Consent Agenda that included the following items:
(6.1) Council minutes from regular meeting of August 8, 2023.
(6.2) Resolution approving disbursements ending August 11, 2023 (Res2023-213).

(6.3) Resolution designating consulting engineer for final design engineering for the Plymouth
Boulevard Rehabilitation Project (ST240001) (Res2023-214).
(6.4) Resolution designating consulting engineer for the Frick’s Garden Street Reconstruction Project
(ST259001) (Res2023-215).
(6.5) Resolution accepting streets for continual maintenance for Serenity on Plymouth Creek
(2014050) (Res2023-216), Resolution accepting Holly Lane for continual maintenance for Timbers Edge
(2018044) (Res2023-217).
(6.6) Resolution approving amendment to existing police ordered towing and impound contract for
2021-2024 (Res2023-218).
(6.7) Resolution authorizing execution of agreement with the Department of Public Safety, Office of
Traffic Safety for the DWI officer grant (Res2023-219).
(6.8) Resolution approving temporary liquor license application of Wooden Hill Brewing Company LLC
(Res2023-220).
With all members voting in favor, the motion carried.
Public Hearings
(7.1) Public hearing on wine and on-sale 3.2 percent malt liquor license applications of Asian Duck
LLC d/b/a Asian Duck, 16605 County Road 24, Suite 205
Mayor Wosje noted the applicant had withdrawn their request, so no action would be taken on this
item.
General Business
(8.1) Approval of a joint powers agreement providing potable water service to the City of Medicine
Lake
Public Works Director Thompson presented this item.
It was noted the City Council passed the agreement last year but reviewed it tonight due to previous
bonding bill delays and minor changes in timelines and fees. Public Works Director Thompson provided
details on costs, timeline, maintenance, plumbing and various fees. He also stated Plymouth would own
and maintain the water system.
Medicine Lake Mayor Chris Heim, 18 Kaiser Avenue, thanked the City of Plymouth for their continued
partnership. He noted residents do not have city water and many of the wells and the sewer system are
old and in need of repair. He noted the project would go out for bid and construction would begin spring
of 2024 with completion by the end of 2024.

Public Works Director Thompson added each property in Medicine Lake will receive a hub allowing the
resident to hook up and stated over the next 10 years, approximately 75% of the residents should be
hooked up.
Mayor Wosje thanked Mayor Heim for the continued partnership.
Motion was made by Councilmember Peterson, and seconded by Councilmember Willis, to adopt
Resolution authorizing execution of joint powers agreement between the City of Medicine Lake and the
City of Plymouth for potable water service (Res2023-221). With all members voting in favor, the motion
carried.
(8.2) Approve conversion of Vicksburg Lane from four lanes to three lanes
Deputy Public Works Director/City Engineer LaBounty presented this item and summarized the traffic
study of Vicksburg Lane. He noted neighborhood concerns were traffic access and speed. The completed
study identified concerns regarding crashes and speeding. The study also looked at safety improvements
converting it from four lanes to three with one lane in each direction and a shared middle turn lane. The
project would be completed with minimal infrastructure investment and minimal impacts to levels of
service.
In response to questions from the City Council, Deputy Public Works Director/City Engineer LaBounty
and Public Works Director Thompson provided the following information:
• Resident feedback included videos of near misses
• There will be dedicated right turn lanes and wide shoulders
• Future improvements will be made if traffic increases
• Identified intersections slated for improvements and turn lanes
• Requested approval tonight to complete the project before winter
• Four lanes to remain on Old Rockford Rd., Schmidt Lake Rd., and Chankahda Trail
Motion was made by Councilmember Davis, and Seconded by Councilmember Gregor, to adopt
Resolution authorizing conversion of Vicksburg Lane between Old Rockford Road to Chankahda Trail
from four lanes to three lanes (Res2023-222). With all members voting in favor, the motion carried.
(8.3) Discuss local cannabis regulation
City Attorney Mattick, Public Safety Director Fadden, and Planning and Development Manager McGuire
presented this item.
City Attorney Mattick provided clarification on the new legislation and regulations. City staff are looking
for high level feedback and next steps regarding smoking in public places and a potential moratorium.
He defined and explained the vocabulary surrounding marijuana and hemp products. He discussed low
level potency products and stated higher level products, containing more than 5 mg will be coming in
2025. He also provided a list of the 16 different licenses surrounding cannabis businesses from the Office
of Cannabis Management. Registration for the lower-level hemp licenses is currently going through the
Minnesota Department of Health. City Attorney Mattick also discussed local regulation, zoning
authority, and local revenue.

In response to questions from the City Council, Public Safety Director Fadden provided the following
information:
• If an ordinance is adopted, a violation would not be a criminal offense, but rather a petty
misdemeanor
• Provided a sample ordinance for reference
• Suggested enacting a smoking tobacco ordinance for consistency
• Definition of smoking would include vaping and how it affects others who are in close proximity
• Options for definition of public place
Planning and Development Manager McGuire provided information on current zoning and licensing
regulations but noted a language change has not happened yet. She stated an interim ordinance or
moratorium will allow time to provide a clearer definition for future property and land acquisition and
will allow the city to put in rules and regulations up front to make it more consistent in the future.
Leaving the city without a current ordinance would leave it up for interpretation and the property owner
would get the benefit of the doubt. She noted the information received will provide staff with direction
to pursue the three draft ordinances and will bring them back to City Council at the September 26, 2023
meeting.
