HomeMy WebLinkAboutPlanning Commission Minutes 04-12-2000Approved Minutes City of Plymouth Planning Commission Meeting April 12, 2000 MEMBERS PRESENT: Chairman Mike Stulberg, Commissioners Bob Stein, Kapila Bobra, Roger Berkowitz, Karl Neset, John Stoebner, and Sarah Reinhardt MEMBERS ABSENT: None STAFF PRESENT: Planning Supervisor Barbara Senness, Planner Shawn Drill, Senior Clerk/Typist Janice Bergstrom 1 Call To Order 2 Public Forum 3 Approval of Agenda 4 Approval of Minutes MOTION by Commissioner Bobra, seconded by Commissioner Reinhardt to approve the March 29, 2000 and April 5, 2000 Planning Commission Minutes. Vote. 7 Ayes. MOTION approved unanimously. 5 Consent Agenda 6 PUBLIC HEARINGS A KENNETH SEARL (20037) Chairman Stulberg introduced the request by Kenneth Searl for a conditional use permit to exceed 50 percent office use in an industrial district for property located at 14700 28t11 Avenue North. Planner Drill gave an overview of the April 5, 2000 staff report. Chairman Stulberg introduced the petitioner, Kenneth Searl, who concurred with the conditions attached to the staff report. Chairman Stulberg opened the public hearing. Chairman Stulberg closed the public hearing. MOTION by Commissioner Stoebner, seconded by Commissioner Berkowitz recommending approval of a conditional use permit for Kenneth Searl to exceed 50 percent office use in an Approved Planning Commission Minutes April 12, 2000 Page #2 industrial district for property located at 14700 28th Ave. N. Roll Call Vote. 7 Ayes. MOTION approved unanimously. B RELIANCE DEVELOPMENT COMPANY, LLC (20004) Chairman Stulberg introduced the request by Reliance Development Company for a site plan and conditional use permits for retail development including a bank with drive-through, convenience store with fuel and car wash, two drive-through restaurants, and a day care facility on property located at the northwest corner of Highway 55 and Peony Lane. Planner Shawn Drill gave a brief overview of the April 5, 2000 staff report. Planner Drill stated that on April 5 the City's wetland specialist and the applicant encountered discrepancies between the mapped and actual locations of wetlands. Staff requested that the public hearing be continued in order to allow time needed to resolve the wetland issues. Planner Drill noted that the proposed site plan may change depending on the wetland issues. He added that property owners within 500 feet would be re -notified when the application is brought back to the Planning Commission. Commissioner Berkowitz asked if the only issue for the continuance relates to the wetlands. Planner Drill replied affirmatively. Commissioner Stoebner asked about the City's review deadline and whether that will create a problem for continuing the item. Planner Drill stated that the City's deadline is June 24, and options will be for the applicant to extend the review period or the City may need to take action to deny if the wetland issue is not resolved within the next month or so. Planning Supervisor Senness added that a technical evaluation panel will meet to determine the locations of the wetland boundaries. She felt a three week extension would not be adequate when changes to the site plan may be necessary. Chairman Stulberg introduced the applicant, Vince Driessen. Mr. Driessen did not have comments at this time. Chairman Stulberg opened the public hearing. Chairman Stulberg introduced Ann Harless of 18120 45th Avenue North. Ms. Harless stated that as a resident of the Plum Tree neighborhood, she has concerns about this proposal including the fact that every facility on the drawing has a drive-through. She felt the traffic, noise, and quality of life for residents on 45th Avenue who look over this development will be affected and asked how these issues will be taken in to account. Chairman Stulberg replied this will be addressed when there is a site plan to review. He clarified the City is only looking to approve or deny the request, and that the City of Plymouth is not proposing the development. Ms. Harless inquired as to what type of buildings will be acceptable on the site and how will a homeowner be protected in regard to noise and light. Chairman Stulberg advised all of these issues are covered in the ordinance. These are items that will be addressed when the plans are finalized. Approved Planning Commission Minutes April 12, 2000 Page #3 Chairman Stulberg introduced Brian Harless of 18120 45the Avenue North. Mr. Harless stated his main concern is noise, due to the fact they are close to the high school, and drive through and fast traffic already exist and would increase. Chairman Stulberg introduced Joe Rupar of 18140 Highway 55. Mr. Rupar stated he has resided at this address for 28 years. The property being discussed has always been zoned commercial and he would like to see it developed as commercial. Mr. Rupar feels there is no way to regulate traffic on Highway 55. He added that if homeowners to the north want trees and fences to eliminate noise and traffic, they could put them on their property. Mr. Rupar favors this development and feels it serves a need in western Plymouth. MOTION by Commissioner Stein, seconded by Commissioner Stoebner to continue the public hearing. Vote. 7 Ayes. MOTION approved unanimously. Commissioner Berkowitz questioned what type of business is allowed in a C-3 zone. Planning Supervisor Senness responded C-3 is auto and service oriented as opposed to retail. Commissioner Berkowitz asked if those businesses could be processed which are already allowed without a conditional use permit. Chairman Stulberg stated the bank is the only building that would be a permitted use in the C-3 zone without a conditional use permit. 7 New Business No items. MOTION by Sarah Reinhardt, seconded by Kapila Bobra to adjourn. Vote. 7 Ayes. MOTION approved unanimously. The meeting was adjourned at 7:22 p.m.
