HomeMy WebLinkAboutPlanning Commission Minutes 08-01-2001Approved Minutes City of Plymouth Planning Commission Meeting August 1, 2001 MEMBERS PRESENT: Acting Chairman Roger Berkowitz, Commissioners Peggy Larson, David Gaither, Kapila Bobra, Sarah Reinhardt, and Karl Neset MEMBERS ABSENT: Chairman Michael Stulberg STAFF PRESENT: Community Development Director Anne Hurlburt, Senior Planner Marie Darling, Associate Planner Josh Doty and Office Support Specialist Ranelle Gifford 1 CALL TO ORDER 2 PUBLIC FORUM 3 APPROVAL OF AGENDA 4 APPROVAL OF MINUTES MOTION by Commissioner Reinhardt, seconded by Commissioner Bobra to approve the July 18, 2001 Planning Commission Minutes. Vote. 6 Ayes. MOTION approved unanimously. 5 CONSENT AGENDA A MAX AND PEGGIE EISENBERG (2001055) MOTION by Commissioner Bobra, seconded by Commissioner Reinhardt recommending approval of a variance to allow an impervious surface coverage of 28.4%, where 25% is the maximum, to allow installation of an above ground swimming pool in the rear yard of the property located at 2715 Quaker Lane North. Vote. 6 Ayes. MOTION approved unanimously. 6 PUBLIC HEARINGS A CITY OF PLYMOUTH (2001063) Acting Chairman Berkowitz introduced the request by the City of Plymouth for a Zoning Ordinance Text Amendment regarding voting requirements for zoning ordinance amendments to bring these requirements into conformance with the new state law. Senior Planner Darling gave an overview of the July 27, 2001 staff report. Acting Chairman Berkowitz opened and closed the public hearing as there was no one present to speak on the item. Approved Planning Commission Minutes August 1, 2001 Page #2 MOTION by Commissioner Reinhardt seconded by Commissioner Gaither recommending approval of a Zoning Ordinance Text Amendment to comply with new statutory requirements. Roll Call Vote. 6 Ayes. MOTION approved unanimously. B ASIAN ANTIQUE FURNITURE (2001078) Acting Chairman Berkowitz introduced the request by Asian Antique Furniture for a Zoning Ordinance Text Amendment to allow furniture stores with less than 5,000 square feet of gross floor area in the C-3 Zoning District. Associate Planner Doty gave an overview of the July 20, 2001 staff report. Acting Chairman Berkowitz asked what the square footage of the building was. Associate Planner Doty responded he was unsure of the exact square footing stating it was under 5,000 and that the applicant could give more of a accurate square footage. Acting Chairman Berkowitz asked if the applicant had other options and if these were pursued. Associate Planner Doty explained there were no other options for the applicant. Commissioner Reinheart asked if furniture sales are allowed in other districts. Assocoate Planner Doty replied affirmatively, in the C-2 Zoning District. Director Hurlburt stated there are a few existing buildings but they have very limited vacancies. Director Hurlburt added this type of business is also allowed in the C-4 Zoning District. Commissioner Berkowitz introduced Mr. David Raskas of Asian Antique Furniture, representing the applicant. Mr. Raskas stated he concurs with the staff report. Mr. Raskas confirmed the business occupied 2,750 square feet. Commissioner Reinhardt asked Mr. Raskas if he was the owner or tenant. Mr. Raskas replied he was the tenant leasing the space. Commissioner Reinhardt asked if the owner was aware that this type of business was not allowed in the C-3 zoning district. Mr. Raskas stated the owner thought it was zoned for retail sales. Commissioner Reinhardt asked if the applicant had explored other options or locations. Mr. Raskas stated they had looked at different locations but this location was less expensive and worked the best for traffic visibility. Commissioner Gaither asked Associate Planner Doty if work was being completed without permits. Associate Planner Doty responded affirmatively. Mr. Raskas stated some painting and adding a door had been done but they were unaware a permit was needed. Director Hurlburt added additional work was done to the ceiling and the occupancy was changed. Director Hurlburt stated the building code issues are being resolved. Director Hurlburt stated the City allowed them to operate once we verified that any safety issues were addressed. Commissioner Reinhardt asked if we are changing the ordinance for one business, would there be other uses that would need to be addressed. Director Hurlburt stated the amendment was specifically for this request. Any other cases would be reviewed at a later date. This review covered just the furniture sales. MOTION by Commissioner Gaither seconded by Commissioner Bobra recommending approval of a Zoning Ordinance Text Amendment to allow furniture stores with less than 5,000 square feet of gross floor area in the C-3 zoning district. Roll Call Vote. 6 Ayes. MOTION approved unanimously. MOTION by Commissioner Reinhardt, seconded by Commissioner Bobra to adjourn. Vote. 6 Ayes. MOTION approved unanimously. The meeting adjourned at 7:25 p.m.
