CALL TO ORDER - 7:00 P.M. 2. PLEDGE OF ALLEGIANCE 3. PUBLIC FORUM 4. APPROVAL OF AGENDA MOTION by Commissioner Rohloff, seconded by Commissioner Weir, to approve the June 4, 2003 Planning Commission Agenda. Vote. 6 Ayes. MOTION approved. 5. APPROVAL OF MINUTES MOTION by Commissioner Weir, seconded by Commissioner Holmes, to approve the May 21, 2003 Planning Commission Minutes. Vote. 5 Ayes. MOTION approved. Commissioner Rohloff abstained. 6. CONSENT AGENDA 7. PUBLIC HEARINGS A. MARY MAKI (2003045) Chair Larson introduced the request by Mary Maki for a preliminary plat to divide the existing parcel into two lots and a variance for lot width, for property located at 17335 County Road 24. Planner Bowers gave an overview of the May 27, 2003 staff report. Approved Planning Commission Minutes June 4, 2003 Page 2 Chair Larson asked how much land it would take along County Road 24 for the proposed expansion of the road. Planner Bowers stated it is approximately 22 feet. She stated this additional right-of-way would be shown on the final plat. She stated the proposed building site would meet the required front yard setback, even with the additional right-of-way. Chair Larson introduced Mary Maki, 17335 County Road 24. Ms. Maki stated she is in agreement with the staff report and conditions. Chair Larson opened and closed the public hearing as there was no one present to speak on the item. MOTION by Commissioner Rohloff, seconded by Commissioner Weir, to approve the request by Mary Maki for a preliminary plat to divide the existing parcel into two lots and a variance for lot width, for property located at 17335 County Road 24. Roll Call Vote. 6 Ayes. MOTION approved. B. PILLAR HOMES (2003049) Chair Larson introduced the request by Pillar Homes for a conditional use permit for an attached garage that would exceed 1,000 square feet in area, for property located at 700 Shadyview Lane North. Senior Planner Drill gave an overview of the May 27, 2003 staff report. Chair Larson introduced KC Chermak of Pillar Homes, 125 Lake Street West in Wayzata. Mr. Chermak stated the plan originally showed a storage space over the garage, but due to poor soils and having to dig deeper, they changed the plan to have the storage below the garage. He stated he now has a better understanding of the Zoning Ordinance specification of 1,000 square feet maximum for garages. He stated the verbiage in the Zoning Ordinance is not completely straight forward and could be revised for better understanding. Commissioner Weir asked if the original plan showed the storage below the garage. Mr. Chermak stated the original plan did not show the storage area below the garage. Commissioner Weir asked if the plan should have been revised with City approval prior to the commencement of construction. Approved Planning Commission Minutes June 4, 2003 Page 3 Mr. Chermak stated you can't predict problems of this nature. Mr. Chermak stated the plan was revised after the work was done. Commissioner Rohloff asked if this was caught during a routine City inspection. Senior Planner Drill answered affirmatively. He stated the builder should not have built the lower level garage before coming to the City for a change in plan approval. He stated once it was discovered, the builder was required to submit revised plans to the Building Division for review and approval. He stated the grading of the lot was also affected by the change in plans. He stated the builder was given the option to block up the garage door opening for the lower level garage, or apply for the conditional use permit. Commissioner Rohloff asked if there have been other instances of confusion over the maximum garage area requirement. Planning Manager Senness stated there have been several requests for conditional use permits for additional garages but without confusion over the maximum garage area of 1,000 square feet. Commissioner Holmes asked if staff is confident building code compliance was met. Senior Planner Drill answered affirmatively. Mr. Chermak stated it was an error on his part and will not happen again. Chair Larson stated it would be wise to exercise caution in future building projects in regards to this oversight. Chair Larson opened and closed the public hearing as no one was present to speak on the item. MOTION by Commissioner Rohloff, seconded by Commissioner Weir, to approve the request by Pillar Homes for a conditional use permit for an attached garage that would exceed 1,000 square feet for property located at 700 Shadyview Lane North.
