R ESOLUTION N O. 2023-192
R ESOLUTION A PPROVING THE V ACATION OF AN E ASEMENT OF L OT 10, B LOCK 2,
B EACON H EIGHTS F IRST A DDITION
WHEREAS, a public hearing with respect to said vacation was scheduled for July 25, 2023, in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of July 25, 2023; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the council held a public hearing on July 25, 2023 to inform any and all interested
parties relevant to the vacation of a portion of the drainage and utility easement of Lot 10 Block 2,
Beacon Heights First Addition, and
WHEREAS, it was determined by the City Council that said drainage and utility easement is not
needed for public purposes.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the following drainage and utility easement be vacated:
To vacate that part of Lot 10 Block 2, BEACON HEIGHTS FIRST ADDITION according to the plat on file and
of record in the office of the county recorder, Hennepin County, Minnesota described as follows:
All of the existing utility easements lying over, under, and across Lot 10, Block 2, as shown on the
plat of BEACON HEIGHTS FIRST ADDITION, according to the recorded plat thereof, Hennepin
County, Minnesota, except that part lying over the North 5.00 feet of said Lot 10.
