HomeMy WebLinkAboutCity Council Resolution 2023-190 C ITY OF P LYMOUTH R ESOLUTION N O. 2023-190 R ESOLUTION A PPROVING THE V ACATION OF A P ORTION OF D RAINAGE AND U TILITY E ASEMENT OF L OT 18, B LOCK 6, H OLLYDALE WHEREAS, a public hearing with respect to said vacation was scheduled for July 25, 2023, in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of July 25, 2023; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the council held a public hearing on July 25, 2023 to inform any and all interested parties relevant to the vacation of a portion of the drainage and utility easement of Lot 18, Block 6, Hollydale; and WHEREAS, it was determined by the City Council that said drainage and utility easement can be vacated under the condition a satisfactory replacement drainage and utility easement in the same location and size, and shape slightly modified and approved by city staff. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the following drainage and utility easement be vacated: To vacate that part of Lot 18, Block 6, HOLLYDALE according to the plat on file and of record in the office of the county recorder, Hennepin County, Minnesota described as follows: A drainage and utility easement over, under and across that part of Lot 18, Block 6, HOLLYDALE, according to the recorded plat thereof, Hennepin County, Minnesota, described as follows: Commencing at the north corner of said Lot 18; thence South 59 degrees 56 minutes 15 seconds East along the northeast line of said Lot 18 a distance of 131.40 feet to the survey line of said Lot 18; thence South 52 degrees 51 minutes 48 seconds West along said survey line a distance of 6.51 feet to the actual point of beginning; thence continuing South 52 degrees 51 minutes 48 seconds West along said survey line a distance of 77.62 feet; thence South 09 degrees 58 minutes 30 seconds East along said survey line a distance of 5.63 feet; thence South 60 degrees 08 minutes 37 seconds West a distance of 12.90 feet; thence South 20 degrees 55 minutes 06 seconds East a distance of 12.15 feet; thence North 60 degrees 08 minutes 37 seconds East a distance of 10.45 feet to the survey line of said Lot 18; thence South 09 degrees 58 minutes 30 seconds East along said survey line a distance of 5.10 feet; thence South 88 degrees 38 minutes 19 seconds East a distance of 18.95 feet; thence North 01 degrees 49 minutes 18 seconds East a distance of 15.08 feet; thence North 23 degrees 59 minutes 19 seconds East a distance of 25.48 feet; thence North 48 degrees 59 minutes 53 seconds East a distance of 12.92 feet; thence Resolution 2023-190 Page 2 North 53 degrees 03 minutes 08 seconds East a distance of 32.16 feet; thence North 59 degrees 56 minutes 15 seconds West a distance of 8.58 feet to the point of beginning. Easement Vacation Area: 1,357 sq ft. BE IT FURTHER RESOLVED that recording of this vacation resolution shall be accomplished with the recording of the replacement drainage and utility easement granted by the petitioner.
