HomeMy WebLinkAboutCity Council Ordinance 2023-07 CITY OF PLYMOUTH ORDINANCE No. 2023-07 ORDINANCE REPEALING ORDINANCE 2022-15 AN INTERIM ORDINANCE PROHIBITING THE SALE, TESTING, MANUFACTURING, AND DISTRIBUTION OF INTOXICATING AND PSYCHOACTIVE CANNABINOIDS THE CITY OF PLYMOUTH, MINNESOTA ORDAINS: Section 1. Background: A. Minn.Stat.462.355,subd.4, provides that a municipality may adopt an interim ordinance for the purpose of protecting the planning process and the health,safety,and general welfare of its residents. Minn.Stat.§412.221,subd.32 provides that a city is authorized to regulate any use in order to promote the health,safety,and welfare of its citizens. B. The City Council adopted Ordinance 2022-15,an interim ordinance prohibiting the sale, testing, manufacturing,and distribution of THC Products for one year.That ordinance became effective on September 13,2022. C. City staff and the City Council studied and reviewed the need for local controls of THC- containing products in light of 2023 Session Laws Chapter 63, regulating the production and sale of THC products. D. An interim ordinance prohibiting the sale of THC products in the City is no longer necessary because the State statute imposes sufficient control over the sale and consumption of THC products. Section 2. Repeal: Ordinance 2022-15,an interim ordinance prohibiting the sale,testing, manufacturing,and distribution of intoxicating and psychoactive cannabinoids, is repealed in its entirety.
