HomeMy WebLinkAboutCity Council Resolution 2023-102 C ITY OF P LYMOUTH R ESOLUTION N O. 2023-102 R ESOLUTION A PPROVING A F INAL P LAT FOR E NCLAVE C OMPANIES FOR “B ASS L AKE P LAZA 6 TH A DDITION” FOR PROPERTIES LOCATED WEST OF H IGHWAY 169 AND SOUTH OF C OUNTY R OAD 10 AT N ATHAN L ANE – 5750 N ATHAN L ANE, AND PID N UMBERS 01-118-22-42-0049, 01-118-22-42-0007, AND 01-118-22-42-0010 (2023002) WHEREAS, Enclave Companies has requested approval of a final plat for roughly 19.9 acres of land presently legally described as follows: Parcel 1: Outlot A, Bass Lake Plaza 4th Addition, according to the recorded plat thereof, Hennepin County, Minnesota. Parcel 2: Those parts of the Northeast Quarter of the Southeast Quarter AND of the Northwest Quarter of the Southeast Quarter, Section 1, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Commencing at the Northeast corner of said Northwest Quarter of the Southeast Quarter; thence South 89 degrees 40 minutes 21 seconds West, along the North line of said Northwest Quarter of the Southeast Quarter, a distance of 330.00 feet; thence South 00 degrees 13 minutes 56 seconds East, parallel with the East line of said Northwest Quarter of the Southeast Quarter, a distance of 81.23 feet to the point of beginning of the property to be described; thence continuing South 00 degrees 13 minutes 56 seconds East, parallel to said East line, a distance of 380.77 feet; thence North 89 degrees 40 minutes 21 seconds East, parallel with said North line, a distance of 330.00 feet to said East line; thence North 00 degrees 13 minutes 56 seconds West, along said East line, a distance of 167.00 feet; thence North 89 degrees 42 minutes 04 seconds East a distance of 295.00 feet; thence North 00 degrees 13 minutes 56 seconds West, parallel with said East line, a distance of 176.32 feet; thence North 84 degrees 03 minutes 55 seconds West a distance of 299.55 feet, passing through a point in said East line distant 86.46 feet Southerly from the Northeast corner of said Northwest Quarter of the Southeast Quarter; thence North 89 degrees 28 minutes 06 seconds West a distance of 327.12 feet to the point of beginning, Hennepin County, Minnesota. Parcel 3: Lot 1, Block 1, Bass Lake Plaza 4th Addition, according to the recorded plat thereof, Hennepin County, Minnesota. Parcel 4: Lot 1, Block 1, Bass Lake Plaza 5th Addition, according to the recorded plat thereof, Hennepin County, Minnesota. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Enclave Companies for a final plat Resolution 2023-102 (2023002) Page 2 for Bass Lake Plaza 6th Addition for four lots on 19.9 acres at the above-described property, subject to the following conditions: 1. The final plat for Bass Lake Plaza 6th Addition, for four lots is approved to allow a mixed-use development consisting of both multi-family residential (4-story, 219 units) and retail uses (two new buildings, totaling 10,200 square feet, in addition to existing gas station to remain) in accordance with the plans received by the city on January 19 and 31, 2023, except as may be amended by this resolution. 2. PUD flexibility is approved to allow: 1) reduced parking for the multi-family building at 1.7 parking spaces where 2.0 is required and 2) up to 14.5 percent efficiency or alcove units where up to 10 percent is permitted. 3. Prior to recording the final plat, the developer shall: a. Execute the development contract and provide the related financial guarantees and fees. b. Execute the Storm Water Maintenance Agreements. c. Execute any Rain Garden Maintenance Agreements, as applicable. d. Receive city approval of final construction plans. e. Compliance with all fire codes, including those for hydrant location and fire lane signage. f. Pay the required park dedication fee. g. Provide all required easements and agreements. 4. Prior to commencement of grading operations, or other site preparation work, the developer shall: a. Install and request inspection of all required pre-disturbance erosion control best management practices including, but not limited to, perimeter controls, rock construction entrances, and inlet protection. b. Update the plans and specifications to be in conformance with the rules set forth in the City of Plymouth Engineering Guidelines & Standard Detail Specifications for Sanitary Sewer, Watermain, Storm Sewer and Street Construction, dated January 2022, and: 1. Staff approval of implementation of Engineering Guidelines and Specifications. 2. Confirm Storm Water Report, Stormwater Pollution Prevention Plan, and Erosion Control Plan approved by staff in accordance with applicable rules. 3. Confirm consistency of easements with proposed infrastructure as detailed by City Specifications. 4. Provide documentation that all environmental-related permits have been received and obtain all applicable agency permits or approvals that are required including, but not limited to, those from MnDOT, Hennepin County, Shingle Creek Watershed Districts, Metropolitan Council Environmental Services, Minnesota Pollution Control Agency, Minnesota Department of Health, Minnesota Department of Natural Resources (MnDNR), Army Corps of Engineers, Federal Emergency Management Agency (FEMA), as well as the NPDES permit. c. Demonstrate compliance with City and watershed requirements pertaining to drainage, treatment of runoff, and runoff rates. Note that approval of the storm water management plan Resolution 2023-102 (2023002) Page 3 for this development remains pending until approval by the watersheds, WCA, MN DNR, and Army Corps of Engineers is obtained. d. Provide a snow storage/snow removal plan and chloride management plan for the site. e. Revise the plat to include the standard 6-foot side and rear yard, and 10-foot front yard drainage and utility easements, including areas within wetland buffers, and existing and proposed utilities. f. Revise the site plans to identify the proposed setbacks of buildings, parking spaces and drive aisles to property lines to meet setback requirements. g. Revise the site plan to include bike parking (bike racks) in both the multi-family residential and retail properties. h. Revise the site plan to remove any proposed retaining walls from drainage and utility easements. i. Provide additional details on the architecture on the commercial portion of the PUD and demonstrate how it is compatible with the architecture of the multi-family building to support the mixed-use development. j. Provide/identify house-side shielding of light fixtures (if located within 300 feet of residential property). k. Revise the site plan to include trails (8-foot wide) extending from the existing sidewalk along the west side of Nathan Lane within the ROW from just north of 57th Avenue to Bass Lake Road, along the east side of Nathan Lane within the ROW from the northernmost entrance to the multi-family building parking lot to Bass Lake Road and 8-foot trail within the ROW on the north side of the property, along Bass Lake Road, from Nathan Lane to the Highway 169 interchange. l. Provide a 10-foot-wide trail easement along the north side of the property, along Bass Lake Road, from Nathan Lane to the Highway 169 interchange. 5. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. File and provide proof of recording for the final plat and all easements and agreements with Hennepin County. b. Submit and receive approval of the required PUD final plan for the buildings. c. Complete grading operations and provide a grading certificate as certified by the licensed project engineer. d. Install and request inspection of tree protection fencing and silt fencing. e. The lowest floor elevations must comply with FEMA floodplain requirements and the 1.5-foot higher than the emergency overflow elevation requirement. f. Obtain City approval of final fire department plans, including: Fire related comments related to the multi-family residential building: 1. Provide fire flow calculations. 2. Provide fire sprinklers throughout. 3. Fire department connection (FDC) shall be placed near front door. 4. Fire alarm panel must monitor the sprinkler system and detectors that are required. A UL certificate is required. 5. Fire hydrants must be placed all around building, per City spacing requirements. One hydrant must be placed within 50 feet of the FDC. Three fire department lock boxes will be required, main entrance, east and west stair entrances. 7. 12-inch-high address numbers are required on west and south side of building. Fire related comments related to the commercial buildings: 8. Provide fire flow calculations. 9. Provide fire sprinkler throughout. 10. Fire department connection (FDC) shall be placed near front door. A fire hydrant is required within 50 feet of the FDC. 11. Fire alarm panel is required to monitor the fire sprinkler system. A UL certificate is required. 12. Fire department lock box is required at main entrance. 13. East building will be required to have directional sign at south drive entrance of the gas station showing the address numbers of and arrow of new building. g. Submit a copy of the declaration of easements, covenants, conditions, and restrictions (ECCR) access between the C-Store Parcel and the West Commercial Parcel for City review. The ECCR document shall address responsibilities for maintenance, repair, and replacement of Developer- installed improvements including, but not limited to, applicable drive aisles, sidewalks, trails, water quality features, signage, and other similar or common site features between the C-Store Parcel and the West Commercial Parcels. 6. Prior to occupancy of any proposed buildings on the site, the following items shall be addressed: a. Construction of the ponding and drainage system shall be completed. b. All permanent wetland buffer monument signs shall be installed pursuant to ordinance requirements. 7. Connection to all city utilities must be witnessed and inspected by city staff. The developer shall provide proper notice of connection to the city. Connections to the city water system that require a water shut down may be required to occur at nighttime. 8. Trash and recyclables generated by residential buildings shall be stored inside the apartment building. Trash and recyclables generated by commercial buildings shall be stored in dumpster enclosures that are designed to match the materials of the commercial buildings. Dumpsters shall be located such that they prevent illicit discharge into the storm sewer system. 9. All site lighting for the development shall be designed to match throughout the development. 10. Sidewalks along the north side of 56th Avenue and the east side of Nathan Lane and sidewalks within the site shall be owned and maintained by the developer. 11. No recreational vehicles shall be stored or maintained in this PUD. 12. No outside storage or display of goods or merchandise shall be allowed in this PUD. 13. Construction parking for this development shall occur on the site, or pursuant to a construction parking plan approved by the city. Resolution 2023-102 (2023002) Page 5 14. If the city determines that there is a parking shortage on the site at any point in the future, the developer shall be required to provide additional parking spaces as indicated in the proof of parking provided by the developer. 15. Structures shall comply with the following architectural design standards: a. All structures shall have high quality finishes and shall be constructed of durable materials. The primary exterior surfaces shall include brick, glass, split-face integral-colored decorative block, stone, and approved fiber-cement panels. b. Painted block is prohibited. c. All building elevations shall receive equal or nearly equal treatment and visual qualities. d. Building colors shall be harmonious throughout the development. e. Any parapets visible from the back shall be treated to coordinate with the building. f. Any visible rooftop or ground-mounted mechanical equipment shall be screened or painted to match the building. Materials for any screening elements shall be coordinated with the building design and architecture. Any such screening elements proposed shall be reviewed by city staff and shall receive city staff approval prior to installation. g. Buildings shall have varied and interesting detailing. The use of large unadorned walls unrelieved by architectural detailing (such as change in materials, change in color, offsets, or other significant visual relief) shall be prohibited. h. Uniform materials shall be incorporated on all structures. The use of varied textures is encouraged. i. Elevations of all sides of a proposed building shall be submitted with the required PUD final plan, for determination of compliance with the above requirements. 16. Signage shall comply with the following standards: a. Applicant shall submit a master sign plan, for city review and approval, and in accordance with the plans and standard sign criteria, except as amended by this resolution. b. All signs shall conform to section 21155.05 (Signs - General Regulations and Restrictions) of the zoning ordinance, except as amended herein. c. Signs shall be designed and constructed in a uniform manner and, to the extent possible, as an integral part of the building’s architecture. d. All wall signs shall consist of individual dimensional letters and logos and shall be architecturally compatible with the building and other signage in the development. e. Illuminated wall signs shall consist of channel letters with acrylic facing or reverse channel letters (halo-lighted). Externally illuminated wall signs by a separate light source shall be prohibited. f. Wall signs shall not extend more than eight inches beyond the face to which the sign is mounted. g. Back-lit awnings are prohibited. h. Inflatable advertising devices and searchlights are prohibited. i. Window signs shall be prohibited. j. Temporary signage shall comply with Zoning Ordinance requirements. k. Directional signage and address signage shall comply with Zoning Ordinance requirements. l. Exposed neon tubing for signage or accent purposes is prohibited. 17. Standard Conditions: Resolution 2023-102 (2023002) Page 6 a. No building permits shall be issued until the final plat is recorded, and until any city utilities are installed, tested, and approved along its proposed or re-aligned route. b. Hours of operation for site preparation work including building demolition, utility installation, foundation piling installation, and grading shall be limited as follows: Monday through Friday 7 a.m. to dusk; Saturdays 8 a.m. to 6 p.m.; Sundays and Holidays no work allowed. Hours of operation for site development work including building construction shall be limited as follows: Monday through Friday 7 a.m. to 10 p.m.; Saturdays, Sundays, and Holidays 8 a.m. to 9 p.m. c. Any signage shall require separate permits and shall comply with the city’s sign regulations. d. Compliance with the city’s lighting regulations. e. Compliance with the city’s tree preservation, reforestation, and restitution regulations. f. No trees shall be planted in the boulevard, or drainage and utility easements affecting utilities and their possible future maintenance. g. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of City Code.
