HomeMy WebLinkAboutCity Council Resolution 2023-083 C ITY OF P LYMOUTH R ESOLUTION N O. 2023-083 R ESOLUTION A PPROVING A F INAL P LAT FOR M ISSION P ONDS H OMEOWNERS A SSOCIATION FOR “M ISSION P ONDS 3 RD A DDITION” FOR PROPERTY LOCATED AT THE N ORTHWEST C ORNER OF Z ACHARY L ANE AND 36 TH A VENUE – PID N O. 14-118-22-44-0137 (2023007) WHEREAS, Mission Ponds Homeowners Association has requested approval of a final plat for roughly 1.85 acres of land presently legally described as follows: Beginning at the most easterly corner of Lot 3, Block 3 Mission Hills Park Second Addition according to the plat on file and of record in the office of the County Recorder, Hennepin County, Minnesota; thence north 32 degrees 28 minutes 10 seconds west assumed bearing along the northeasterly line of said Lot 3 a distance of 176.18 feet to the most northerly corner of said Lot 3; thence easterly along a non-tangential curve concave to the south, having a radius of 228.48 feet, a central angle of 33 degrees 00 minutes, 00 seconds, an arc length of 131.59 feet, a chord length of 129.78 feet and a chord bearing of north 74 degrees 01 minutes 50 seconds east; thence south 00 degrees 31 minutes 50 seconds west a distance of 92.00 feet; thence south 34 degrees 28 minutes 10 seconds east a distance of 80.57 feet; thence south 70 degrees 55 minutes 01 seconds west a distance of 79.30 feet to the point of beginning and there terminating. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mission Ponds HOA for a final plat for Mission Ponds 3rd Addition for one additional single-family lot at the above described property, subject to the following conditions: 1. The final plat for Mission Ponds 3rd Addition, for one additional single-family lot is approved in accordance with the plans received by the City on January 23 and 28, 2023, except as may be amended by this resolution. 2. Setbacks shall be pursuant to the RSF-2 standards, no variances are approved or implied. 3. Prior to commencement of grading operations, the developer shall install and request inspection of tree preservation fencing and silt/erosion control fencing. 4. Prior to recording the final plat, the developer shall: a. Receive approval of final construction plans. b. Obtain any necessary Bassett Creek Watershed approvals and permits. c. Revise the plat to show the standard 6-foot side yard drainage and utility easements and to include the 100-year flood elevation, waterway, and area taking drainage from the east in the rear yard within a drainage and utility easement. Revise the structure setback lines to include 25 feet from the front and rear property lines, and 10 feet on the side to living space and 6 feet on the side to attached garage space. e. Revise the grading plan to adjust the site grades to flow along the side yards to prevent water from flowing onto adjacent properties. f. Revise the plans to include a stream buffer from the waterway pursuant to the stream buffering requirements identified in Section 21665.04, Subd. 7 of the zoning ordinance. g. Pay the required park dedication fees. 5. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. File and record the final plat with Hennepin County. b. Vacate the existing drainage and utility easement on the portion of the Outlot that will become the new single-family lot. c. Install park boundary markers, in approved locations. d. Install and request inspection of tree protection fencing and silt fencing. e. Complete grading operations and provide a grading certificate as certified by the licensed project engineer. f. Provide a certificate of survey indicating a minimum of two front yard trees to be planted and provide the necessary escrow to ensure the planting of the trees. One front yard and one rear yard tree will be permitted on the narrower lots where two trees would not be feasible in the front yard. g. Provide a disclosure statement to the buyer of Lot 8, Block 2 regarding the likelihood of it becoming a corner lot in the future. It shall also detail the removal of the temporary cul-de-sac turn-around, including restoration of the disturbed area with sod and irrigation system, on this lot. This shall be the responsibility of the developer of the property to the north upon its development. h. The lowest floor elevation must comply with the 1.5-foot higher than the emergency overflow elevation requirement. 6. No landscaping is permitted within the 100-year flood elevation waterway. 7. Pursuant to Section 524.07 of the subdivision regulations, the sidewalk requirement for the new lot is waived. 8. Standard Conditions: a. No building permit shall be issued until the final plat is filed and recorded with Hennepin County. b. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a minimum 42-inch high fence shall be installed at the top of retaining walls that exceed four feet in height. c. Compliance with the city’s tree preservation, reforestation, and restitution regulations. d. Removal of all hazardous trees at the owner's expense. e. No trees shall be planted in the boulevard. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under section 512 of City Code.
