R ESOLUTION N O. 2023-082
R ESOLUTION A PPROVING THE V ACATION OF A P ORTION OF D RAINAGE AND U TILITY
E ASEMENT OF L OT 13, M ISSION P ONDS
WHEREAS, a public hearing with respect to said vacation was scheduled for February 28, 2023,
in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted one week
prior to the meeting of February 28, 2023; and
WHEREAS, a public hearing was opened on February 28, 2023 and continued to March
14, 2023; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council held a public hearing on February 28, 2023 and March 14, 2023 to inform
any and all interested parties relevant to the vacation of a portion of the Drainage and Utility Easement
of Lot 13, MISSION PONDS; and
WHEREAS, it was determined by the City Council that said Drainage and Utility Easement is not
needed for public purposes; and
WHEREAS, the proposed plat will create a new property within Mission Ponds Lot 13 Block 1,
including dedicating easements to maintain the city’s needs.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the following Drainage and Utility Easement be vacated:
To vacate that part of Lot 13, MISSION PONDS according to the plat on file and of record in the office of
the county recorder, Hennepin County, Minnesota described as follows:
Beginning at the most easterly corner of Lot 3, Block 3, MISSION HILLS PARK SECOND ADDITION
according to the plat on file and of record in the office of the county recorder, Hennepin County,
Minnesota; thence North 32 degrees 28 minutes 10 seconds West assumed bearing along the
northeasterly line of said lot 3 a distance of 176.18 feet to the most northerly corner of said lot 3;
thence easterly along a nontangential curve concave to the south, having a radius of 228.48 feet, a
central angle of 33 degrees 00 minutes 00 seconds, an arc length of 131.59 feet, a chord length of
129.78 feet and a chord bearing of North 74 degrees 01 minutes 50 seconds East; thence South 00
degrees 31 minutes 50 seconds West a distance of 92.00 feet; thence South 34 degrees 28 minutes 10
seconds East a distance of 80.57 feet; thence South 70 degrees 55 minutes 01 seconds West a distance
of 79.30 feet to the point of beginning and there terminating.

BE IT FURTHER RESOLVED that recording of this vacation resolution shall be accomplished with
the recording of the replacement Drainage and Utility Easement granted by the petitioner.
