R ESOLUTION N O. 2023-078
R ESOLUTION A PPROVING E NCROACHMENT A GREEMENT
FOR A S HED ON P ROPERTY L OCATED AT 16100 5 TH A VENUE N ORTH
WHEREAS, Steve Olson and Janet Olson, property owners, have requested the city approve an
encroachment agreement allowing an existing shed within drainage and utility easements at 16100 5th
Avenue North; and
WHEREAS, the encroachment agreement permits only the shed within the easements and all related
facilities must still meet all applicable city codes; and
WHEREAS, the property is legally described as:
Lot 9, Block 1, Birchwood Estates Addition; and
WHEREAS, as stated in the encroachment agreement, if the city requests that the structure needs to be
removed in the future, it will be at the property owners’ expense.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the encroachment agreement allowing a shed within drainage and utility easements
located at 16100 5th Avenue North is approved.
APPROVED by the City Council on this 14th day of March, 2023.
