R ESOLUTION N O. 2023-069
R ESOLUTION A PPROVING T EMPORARY E ASEMENT FOR THE
H WY 169/36 TH A VENUE B RIDGE R EPLACEMENT P ROJECT
WHEREAS, the Minnesota Department of Transportation “MnDOT” has established and designated
the route of Trunk Highway No. 169 which travels within the City of Plymouth municipal limits; and
WHEREAS, MnDOT has planned improvements, State Project No. 2772-125, for the replacement of
the interchange of Highway 169 and 36th Avenue; and
WHEREAS, said improvements include rehabilitation of a portion of 36th Avenue west of the
interchange; and
WHEREAS, proposed improvements include construction of Americans with Disability Act “ADA”
compliant ramps and a pedestrian sidewalk at the southwest quadrant of the interchange; and
WHEREAS, MnDOT has requested the city approve a no fee temporary permit to construct the ADA
compliant ramps and pedestrian sidewalk on land which the City of Plymouth has interest in; and
WHEREAS, the temporary permit would be effective immediately and expire on December 1, 2026 or
when construction has been completed.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the Mayor and City Manager are authorized and directed to enter into this Temporary
Permit to Construct for Governmental Entities with MnDOT in the name of the City of Plymouth for Parcel
221A of the Highway 169/36th Avenue Bridge Replacement Project as shown in Right of Way Exhibit A.
APPROVED by the City Council on this 14th day of March, 2023.
