R ESOLUTION N O. 2023-009
R ESOLUTION A PPROVING L EASE A GREEMENT S ECOND A MENDMENT
WITH N EW C INGULAR W IRELESS PCS, LLC (P REVIOUSLY AT&T)
FOR W ATER T OWER LOCATED AT 4425 Z ACHARY L ANE
WHEREAS, the City Council has previously adopted a policy statement regarding the use of City
owned land for wireless telecommunication antennas and towers; and
WHEREAS, the City is currently entered into a lease agreement with New Cingular Wireless PCS,
LLC (previously known as AT&T) for telecommunication equipment installed at the water tower located
at 4425 Zachary Lane; and
WHEREAS, said agreement was entered into on September 22, 2008; and
WHEREAS, New Cingular Wireless PCS, LCC has requested to modify the lease agreement with
terms outlined in the second amendment to the agreement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the renewal agreement amendment with New Cingular Wireless PCS, LLC, for the
water tower located at 4425 Zachary Lane is approved.
BE IT FURTHER RESOLVED, that the Mayor and City Manager are authorized to sign said
agreement amendment.
