HomeMy WebLinkAboutCity Council Resolution 2022-309 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-309 R ESOLUTION A PPROVING E NCROACHMENT A GREEMENT FOR A R ETAINING W ALL ON P ROPERTY LOCATED AT 850 B ROCKTON L ANE N ORTH WHEREAS, Page Vanatta, have requested the City approve an encroachment agreement allowing a retaining wall within drainage and utility easements at 850 Brockton Lane North; and WHEREAS, the property is legally described as: Lot 10, Block 1, Ferndale North 3rd Addition; and WHEREAS, the encroachment agreement permits only the retaining wall within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, as stated in the encroachment agreement, if the City requests that the structure needs to be removed in the future, it will be at the property owners’ expense. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the encroachment agreement allowing a retaining wall within drainage and utility easements located at 850 Brockton Lane North is approved. APPROVED by the City Council on this 13th day of December, 2022.
