HomeMy WebLinkAboutCity Council Resolution 2022-305 CITY OF PLYMOUTH R ESOLUTION N O. 2022-305 R ESOLUTION A PPROVING F INDINGS OF F ACT FOR THE R EZONING OF L AND LOCATED WEST OF H IGHWAY 169 AND SOUTH OF B ASS L AKE R OAD AT N ATHAN L ANE - 5750 N ATHAN L ANE, AND PID N UMBERS 01-118-22-42-0049, 01-118-22-42- 0007, AND 01-118-22-42-0010 (2022064) WHEREAS, Enclave Companies has requested reclassification of the zoning from C-2 (neighborhood commercial) and FRD (future restricted development) to PUD (planned unit development) for roughly 18.96 acres presently legally described as follows: Parcel 1: Outlot A, Bass Lake Plaza 4th Addition, according to the recorded plat thereof, Hennepin County, Minnesota. Parcel 2: Those parts of the Northeast Quarter of the Southeast Quarter AND of the Northwest Quarter of the Southeast Quarter, Section 1, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Commencing at the Northeast corner of said Northwest Quarter of the Southeast Quarter; thence South 89 degrees 40 minutes 21 seconds West, along the North line of said Northwest Quarter of the Southeast Quarter, a distance of 330.00 feet; thence South 00 degrees 13 minutes 56 seconds East, parallel with the East line of said Northwest Quarter of the Southeast Quarter, a distance of 81.23 feet to the point of beginning of the property to be described; thence continuing South 00 degrees 13 minutes 56 seconds East, parallel to said East line, a distance of 380.77 feet; thence North 89 degrees 40 minutes 21 seconds East, parallel with said North line, a distance of 330.00 feet to said East line; thence North 00 degrees 13 minutes 56 seconds West, along said East line, a distance of 167.00 feet; thence North 89 degrees 42 minutes 04 seconds East a distance of 295.00 feet; thence North 00 degrees 13 minutes 56 seconds West, parallel with said East line, a distance of 176.32 feet; thence North 84 degrees 03 minutes 55 seconds West a distance of 299.55 feet, passing through a point in said East line distant 86.46 feet Southerly from the Northeast corner of said Northwest Quarter of the Southeast Quarter; thence North 89 degrees 28 minutes 06 seconds West a distance of 327.12 feet to the point of beginning, Hennepin County, Minnesota. Parcel 3: Lot 1, Block 1, Bass Lake Plaza 4th Addition, according to the recorded plat thereof, Hennepin County, Minnesota. Resolution 2022-305 (2022064) Page 2 Parcel 4: Lot 1, Block 1, Bass Lake Plaza 5th Addition, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected land from C-2 and FRD to PUD. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from C-2 and FRD to PUD for roughly 18.96-acres (as legally described above), based on the following findings: 1. The requested PUD zoning would be consistent with MXD guiding. 2. The proposed density would be consistent with MXD guiding. 3. The proposed mixed-use development and lot arrangement would comply with the PUD zoning standards. 4. Adequate infrastructure would be available to support the proposed development. 5. The realignment of Nathan Lane Road is a public benefit by moving traffic further away from the existing residential properties to the west and south. 6. The result of the project would add needed higher-density residential to the housing stock. APPROVED by the City Council on this 29th day of November, 2022.
