R ESOLUTION N O. 2022-284
R ESOLUTION A CCEPTING T ROY L ANE C ONSTRUCTION AND U TILITIES FOR C ONTINUAL M AINTENANCE
FOR C ARLSON R IDGE (2021086)
WHEREAS, in accordance with the development contract dated March 1, 2022, Bald Eagle
Builders, Inc., developer of Carlson Ridge (2021086), has agreed to install certain improvements for said
development; and
WHEREAS, the developer has completed portions of the street, utility and site grading as noted
below; and
WHEREAS, the developer has requested a reduction and release of the required financial
guarantee to reflect the completed work; and
WHEREAS, the developer has requested reimbursement for constructing a portion of public
improvements as outlined in the development contract.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the utilities are accepted for continuous maintenance as of November 15, 2022,
subject to the two-year guarantee by the developer per Letter of Credit No. 218707.
BE IT FURTHER RESOLVED that the Troy Lane construction is accepted for continuous
maintenance as of November 15, 2022, subject to the one-year guarantee by the developer per Letter of
Credit No. 218707.
BE IT FURTHER RESOLVED that funding for the $241,996.80 reimbursement for the public
portion of the Troy Lane construction shall be from the Street Reconstruction Fund.
BE IT FURTHER RESOLVED that the financial guarantee requirements are reduced and released as
follows below and that the required guarantee and Letter of Credit No. 218707 for the items be reduced
from $1,055,748 to $388,203:
