R ESOLUTION A PPROVING E NCROACHMENT A GREEMENTS FOR
A S UBDIVISION M ONUMENT AT F OUR P ROPERTIES WITHIN
H OLLYDALE AND H OLLYDALE 2 ND A DDITION (2022070)
WHEREAS, Hollydale GC Development, Inc., on behalf of the affected property owners, has
requested that the City approve encroachment agreements allowing a subdivision monument within
drainage and utility easements at four properties; and
WHEREAS, the following properties are included in the request:
4705 Garland Lane North, legally described as Lot 4, Block 3, HOLLYDALE 2ND ADDITION
according to the recorded plat thereof, Hennepin County, Minnesota.
4695 Garland Lane North, legally described as Lot 1, Block 3, HOLLYDALE according to
the recorded plat thereof, Hennepin County, Minnesota.
17060 46th Avenue North, legally described as Lot 35, Block 3, HOLLYDALE according to
the recorded plat thereof, Hennepin County, Minnesota.
17065 46th Avenue North, legally described as Lot 26, Block 6, HOLLYDALE according to
the recorded plat thereof, Hennepin County, Minnesota.
WHEREAS, the related encroachment agreements allow only the subdivision monuments within
the easements and all related facilities must still meet all applicable City codes; and
WHEREAS, as stated in the related encroachment agreements, if the City requests that any or all
of the subdivision monuments be removed in the future, it will be at the property owners’ expense.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that encroachment agreements allowing a subdivision monument to be located within
drainage and utility easements at 4705 Garland Lane North, 4695 Garland Lane North, 17060 46th
Avenue North, 17065 46th Avenue North are approved; and
FURTHER, that upon prior execution of the related encroachment agreements by the property
owners, the Mayor and City Manager are authorized to execute the encroachment agreements on the
City’s behalf.
