R ESOLUTION N O. 2022-264
A R ESOLUTION A PPROVING L UCE L INE T RAIL C ONNECTION
C OOPERATIVE A GREEMENT WITH THE S TATE OF M INNESOTA
WHEREAS, the City worked to acquire land for an interconnected trail system; and
WHEREAS, no formalized agreement has been in place to date between the City and the State of
Minnesota for the Luce Line Trail Connections off of 5th Avenue N.; and
WHEREAS, the City has been engaging with the Department of Natural Resources (DNR) to make
the trail connections accessible per DNR requirements and formalizing the cooperative agreement; and
WHEREAS, the City will improve the trail connections from 5th Avenue and will be responsible
for on-going maintenance on City property; and
WHEREAS, depending on the weather, improvements will take place either this fall or next
spring; and
WHEREAS, the City Attorney has reviewed the agreement with recommended changes included;
and
WHEREAS, the City will incur a cost of $41,627.04 that will come from the Capital Improvement
Program utilizing Park Replacement Funds; and
WHEREAS, the DNR has allocated up to $10,000 for this project and is anticipated to contribute
$6,485.56 based on the engineer’s estimate and agreement; and
WHEREAS, staff recommends approval of the agreement and forwarding on to the State of
Minnesota for approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the City Council hereby approves the Luce Line Trail Connection Cooperative
Agreement with the State of Minnesota.
