R ESOLUTION N O. 2022-259
R ESOLUTION A PPROVING E NCROACHMENT A GREEMENTS
FOR R ETAINING W ALLS A T V ARIOUS P ROPERTIES WITHIN C AMELOT N INE AT B EGIN
WHEREAS, the developer, Pulte Homes, on behalf of various property owners, has requested the
City approve an encroachment agreement allowing a retaining wall within drainage and utility
easements; and
WHEREAS, the following addresses are included in the developer’s request:
5550 Empire Lane N
14140 56th Avenue N
14150 56th Avenue N, and
WHEREAS, the properties are legally described as:
Lot 11, Block 2, Camelot Nine at Begin
Lot 6, Block 1, Camelot Nine at Begin
Lot 5 Block 1, Camelot Nine at Begin; and
WHEREAS, the encroachment agreement permits only the retaining wall within the easements
and all related facilities must still meet all applicable City codes; and
WHEREAS, as stated in the encroachment agreement, if the City requests that the structure
needs to be removed in the future, it will be at the property owners’ expense.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the encroachment agreements allowing a retaining wall within drainage and utility
easements located at 14140 56th Avenue N, 14150 56th Avenue N, and 5550 Empire Lane N are
approved.
APPROVED by the City Council on this 25th day of October, 2022.
