HomeMy WebLinkAboutCity Council Resolution 2022-258 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-258 R ESOLUTION A PPROVING E NCROACHMENT A GREEMENTS FOR R ETAINING W ALLS AT V ARIOUS P ROPERTIES WITHIN G REENWAY W EST, G REENWAY W EST 2 ND A DDITION, AND G REENWAY N ORTH 3 RD A DDITION WHEREAS, the developer, Pulte Homes, on behalf of various property owners, has requested the City approve an encroachment agreement allowing a retaining wall within drainage and utility easements; and WHEREAS, the following addresses are included in the developer’s request: 18410 58th Avenue N 18496 58th Place N 5785 Walnut Grove Lane N 5815 Walnut Grove Lane N 5825 Walnut Grove Lane N 5835 Walnut Grove Lane N 18445 58th Avenue N; and WHEREAS, the properties are legally described as: Lot 4, Block 1, Greenway West Lot 1, Block 1, Greenway West 2nd Addition Lot 1, Block 2, Greenway West 2nd Addition Lot 4, Block 2, Greenway West 2nd Addition Lot 5, Block 2, Greenway West 2nd Addition Lot 6, Block 2, Greenway West 2nd Addition Lot 5, Block 9, Greenway North 3rd Addition; and WHEREAS, the encroachment agreement permits only the retaining wall within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, as stated in the encroachment agreement, if the City requests that the structure needs to be removed in the future, it will be at the property owners’ expense. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the encroachment agreements allowing a retaining wall within drainage and utility easements located at 18410 58th Avenue N, 18496 58th Place N, 5785 Walnut Grove Lane N, 5815 Walnut Grove Lane N, 5825 Walnut Grove Lane N, 5835 Walnut Grove Lane N, and 18445 58th Avenue N are approved. APPROVED by the City Council on this 25th day of October, 2022.
