HomeMy WebLinkAboutCity Council Resolution 2022-257 C ITY OF P LYMOUTH R ESOLUTION N O. 2022-257 R ESOLUTION A PPROVING E NCROACHMENT A GREEMENTS FOR R ETAINING W ALLS ON V ARIOUS P ROPERTIES WITHIN E NCLAVE ON THE G REENWAY AND E NCLAVE ON THE G REENWAY 2 ND A DDITION WHEREAS, the developer, Pulte Homes, on behalf of various property owners, has requested the City approve an encroachment agreement allowing a retaining wall within drainage and utility easements; and WHEREAS, the following addresses are included in the developer’s request: 18115 57th Avenue N 18130 57th Avenue N 5643 Shadyview Lane N; and WHEREAS, the properties are legally described as: Lot 7, Block 2, Enclave on the Greenway Lot 9, Block 1, Enclave on the Greenway Lot 8, Block 1, Enclave on the Greenway Second Addition; and WHEREAS, the encroachment agreement permits only the retaining wall within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, as stated in the encroachment agreement, if the City requests that the structure needs to be removed in the future, it will be at the property owners’ expense. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the encroachment agreements allowing a retaining wall within drainage and utility easements located at 18115 57th Avenue N, 18130 57th Avenue N, and 5643 Shadyview Lane N are approved. APPROVED by the City Council on this 25th day of October, 2022.
